GENESEE COUNTY/Indictments

A Genesee County Grand Jury has indicted Lakeisha A. Gibson, 35, of Albion, NY, accusing Gibson of the crime of criminal possession of weapon third degree, a class D felony, menacing second degree, a class A misdemeanor, and three counts of endangering the welfare of a child after allegedly threatening to stab a person with a pair of scissors while in the presence of three children under 17 on April 14, 2022 in the City of Batavia.

Gibson was previously convicted of the crime of attempted criminal mischief, a class B misdemeanor, on January 14, 2020. This conviction forms the basis for count one in the indictment.

Joseph A. Morabito has been indicted by a Genesee County Grand Jury and is accused of the crime of grand larceny third degree, a class D felony, two counts, after allegedly stealing a 1999 CAT D3C bulldozer and property having a value in excess of three thousand dollars, $22,500 in US currency, on April 1, 2017, on Main road in the Town of LeRoy, NY.

Gerald L. Arnett has been indicted and is accused of the crime of aggravated driving while intoxicated, a class E felony, driving while intoxicated as a class E felony, and endangering the welfare of a child after allegedly operating his 2017 Chevy on a public highway in the Town of Byron on February 28, 2022 while in an intoxicated condition with a passenger under the age of 15 or less in the vehicle.

Arnett was previously convicted of driving while intoxicated on September 4, 2013, in the Town of Greece in Monroe County. Such conviction was within 10 years of the crime allegedly committed in count two of the current indictment.

Earl B. Benson has been indicted and is accused of driving while intoxicated as a class D felony, and aggravated unlicensed operation first degree, a class E felony, while allegedly operating a 2008 Chevy on Rt. 19 in the Village of LeRoy while in an intoxicated condition on March 25, 2022.

Benson was previously convicted of driving while intoxicated as a class D felony on September 9, 2014 and on October 13, 2016, both in Erie County. Such convictions form the basis for the suspension or revocation referred to in count two of the current indictment and at the time the crimes alleged were committed, Benson knew of his prior convictions and that his privilege to operate a motor vehicle was suspended or revokes as a result of previous convictions.
