LEROY POLICE REPORT/Pavilion man accused of choking woman in a vehicle and then allegedly attempting to set the vehicle on fire

On August 20, 2022, at about 3:16p.m. members of the LeRoy Police Department responded to a domestic dispute that was occurring in a vehicle on Warsaw road in the Town of LeRoy.

After an investigation, it is alleged that Dean Gardner Jr., 46, of Pavilion, NY, choked the victim until they were unable to breath. The investigation further revealed that Gardner had allegedly grabbed a gas can from the back of his truck, opened the valve on the can and attempted to pour gasoline on the driver’s seat of the vehicle, attempting to light the vehicle on fire while the victim was in the passenger seat.

The victim attempted to contact 9-1-1 but was afraid that Gardner would have heard them speaking to police. The victim then hung up and sent a text message to the Genesee County Dispatch Cener requesting help.

Gardner was placed under arrest and charged with menacing 2nd, criminal obstruction of breathing or blood circulation, attempted arson 2nd degree, criminal possession of a weapon 3rd degree, and criminal possession of a weapon 4th degree.

Gardner was transported to the LeRoy Police headquarters for processing. He was arraigned in LeRoy Town Court and released on his own recognizance and will re-appear in court on September 15, 2022, at 2:00p.m.

Fidel Vargas-Sondoval, 46, of Rochester, NY, is charged with criminal mischief 3rd degree, a class E felony, after a complaint of slashed car tires on Washington street in LeRoy on August 15, 2022.

Vargas-Sondoval was arraigned in LeRoy Town Court on August 19, 2022 for the purpose of an order of protection and released with a new court date.
