PERRY POLICE REPORT/Attica man facing charges after traffic stop on Lake street

PERRY, NY- Chief Michael J. Grover reports the arrest of an Attica, NY resident on drug charges and vehicle and traffic law violations, following an investigation by the Perry Police Department.

On September 6, 2022, at about 6:23p.m. Officer Spencer Kramell conducted a traffic stop on Lake Street for multiple vehicle and traffic law violations. Upon interacting with the suspect, 36-year-old Eric J. Motzer, Officer Kramell suspected Motzer to be impaired.

Officer Kramell requested that Motzer submit to standardized field sobriety tests, which he complied. However, Motzer did not perform the tests as instructed and was subsequently arrested for driving while ability impaired by drugs. He was also charged with driver’s view obstructed and uninspected motor vehicle.

Motzer was transported to the Warsaw Police Department where Officer Anthony Phillips, a Certified Drug Recognition Expert (DRE), was requested to further evaluate Motzer. It was the Officers expert opinion that Motzer was impaired by cannabis and, therefore, was unable to operate a motor vehicle safely on a public highway.

Motzer was processed at the Perry Police Department and released to a sober third party in accordance with NYS bail reform laws. Motzer is to appear in Perry Village Court on 10/11/2022 to answer the charges.
