WYOMING COUNTY SHERIFF’S REPORT/Corfu man jailed on bail following multiple criminal complaints

Paul D. Barth, Jr., 31, of Corfu, NY, was arrested following multiple criminal complaints in the Town of Arcade. Barth was the respondent on multiple protection orders out of Springville, NY and Arcade, NY.

On September 7, 2022, the victim contacted the Wyoming County Sheriff’s Office after reportedly being contacted repeatedly by Barth through text messages. A warrant of arrest was issued, and Barth was arrested on September 8, 2022.

Barth was charged with criminal contempt in the first degree and aggravated family offense, both class E felonies. Barth was arraigned in Arcade Town Court where he was committed to the Wyoming County Jail in lieu of $5,000.00 cash bail, $10,000.00 bond, and $10,000.00 partially secured bond. Barth later posted bond and was released.

On September 10, 2022, the victim again contacted the Wyoming County Sheriff’s Office reporting text message contact from an unknown number, but with similar context to past messages from Barth. An investigation was opened to determine the originating source of the messages.

On September 11, 2022, Wyoming County Sheriff’s deputies located Barth operating his Ford F-350 pickup truck traveling northbound on Route 77 in the Town of Sheldon.

Deputies conducted a traffic stop with Barth on Route 77 for traffic infractions and interviewed him regarding the phone contact with the victim. Barth’s cell phone was seized, and he was also found in possession of two expandable batons in his vehicle. Barth was arrested and charged with criminal possession of a weapon in the third degree, a class D felony. Barth was arraigned in Warsaw Town Court and released on his own recognizance in compliance with NYS Bail Reform.

Following an investigation, through search warrants and subpoenas, Barth was found to have made the unknown contact with the victim through a texting app called TextNow. Barth was also found to have allegedly deleted the TextNow app from his phone as he was pulled over by deputies on September 11, 2022.

On September 29, 2022, Barth was arrested and charged with [5] counts of criminal contempt in the first degree, [5] counts of aggravated family offense, and [1] count of tampering with physical evidence, all class E felonies.

Barth was arraigned in Wyoming County Court where he was committed to the Wyoming County Jail in lieu of $25,000.00 cash bail, $150,000.00 bond, or $250,000.00 partially secured bond.

Barth is scheduled for further court proceedings in Wyoming County Court on October 12, 2022.

Darin Wierzbic, 41, of Arcade, NY, was arrested after Wyoming County Sheriff’s Deputies assisted New York State Parole Officers with a search of a parolee’s residence.

Darin Wierzbic, on NYS Parole following a conviction for criminal possession of a controlled substance in the second degree, was located at his reported residence on Bray Road in the Town of Arcade on September 29, 2022.

Wierzbic was found to allegedly be in possession of amounts of methamphetamine and buprenorphine, along with a digital scale and a double-sided expandable baton. On the date of the search, Wierzbic was arrested by NYS Parole officers for a parole violation and was transported to the Wyoming County Jail where he was held.

On October 1, 2022, Wierzbic was arrested by Wyoming County Sheriff’s Deputies and charged with criminal possession of a weapon in the third degree, a class D felony, two counts of criminal possession of a controlled substance, and criminally using drug paraphernalia in the second degree.

Wierzbic is scheduled to be arraigned in Arcade Town Court on October 6, 2022, on all charges.
