GENESEE COUNTY/Indictments

Ajie J. Smith-Ezell has been indicted by a Genesee County Grand Jury and is accused of the crime of assault in the second degree, a class D violent felony, after allegedly causing serious physical injury to another person on March 12, 2022 in the City of Batavia.

Marcella F. Green has been indicted by a Genesee County Grand Jury and is accused of driving while ability impaired by drugs, a class E felony, reckless driving as a misdemeanor, and criminal possession of a controlled substance 7th degree, after operating a 2003 Dodge on East Main street and North Spruce street in the City of Batavia, while her ability to operate the vehicle was allegedly impaired by drugs on April 22, 2022.

In count 2, Green is accused of endangering users of a public highway, Rt. 63 near Cedar street in the City of Batavia on the same above date

In count 3, Green knowingly an unlawfully possessed a controlled substance, Clonazepam.

Green was previously convicted of driving while ability impaired by drugs as a misdemeanor on March 31, 2022 in Batavia City Court. The conviction was within ten years previous to the commission of the crime alleged in the indictment.

Aaron T. Hendershot has been indicted by a Genesee County Grand Jury and is accused of the crime of criminal mischief second degree, a class D felony, after he allegedly damaged a City of Batavia Patrol vehicle in an amount exceeding $1,500 on September 11, 2022 .

In count 2, Hendershot is accused of criminal mischief fourth degree, a class A misdemeanor, after allegedly damaging another person’s car tires on September 10, 2022 in the City of Batavia.

In count 3, Hendershot is accused of obstructing governmental administration by intentionally obstructing, preventing a public servant from performing an official function by means of intimidation, physical force or interference or by an unlawful act.
