GENESEE COUNTY/Indictments

A Genesee County Grand Jury has indicted Stephen E. Pike, accusing him of the crime of strangulation 2nd degree, a class D violent felony, after allegedly applying pressure on the throat or neck of a person, impeding normal breathing, causing stupor, loss of consciousness for a period of time on August 6, 2022 in the City of Batavia.

In count 2, Pike is accused of criminal mischief 4th degree, a class A misdemeanor, after intentionally damaging the property of another person, an exterior window of a residence in the City of Batavia, on the same above date and location.

In count 3, Pike is accused of assault 3rd degree, after causing physical injury to another person on the same above date and location.

Jamie A. Dutton has been indicted and is accused of the crime of burglary 3rd degree (three counts), a class D felony, after knowingly and unlawfully entering a building, Walmart, located at 4133 Veterans Memorial Drive in the Town of Batavia, with intent to commit a crime therein on August 3, 14, 18, 2022.

Dutton is also accused of petit larceny (two counts), a class A misdemeanor, after allegedly stealing a bicycle on August 3 and 14th, 2022 in the Town of Batavia. On August 18, 2022, Dutton is accused of stealing two wireless keyboards in the Town of Batavia.

Benjamin D. Seekins has been indicted and is accused of the crime of DWI, as a class E felony, after allegedly operating a 2011 Kia on Rt. 5 in the Town of Batavia while allegedly in an intoxicated condition on July 12, 2022.

Seekins was allegedly convicted of the crime of DWI as a misdemeanor on January 28, 2020 in the Town of Avon, NY. Said conviction was within 10 years of the alleged crime in the current indictment.

Scott F. McColl has been indicted and is accused of the crime of DWI, as a class E felony, after allegedly operating a 2006 Harley-Davidson motorcycle on Summit Street Road in the Town of Pavilion on July 14, 2022, while allegedly in an intoxicated condition.

McColl was allegedly convicted of the crime of DWI as a misdemeanor on November 3, 2014 in the City of Batavia. Said conviction was within 10 years of the alleged crime in the current indictment.

John Sumlin III has been indicted and is accused of the crime of criminal contempt 1st degree, a class E felony, after allegedly repeatedly making telephone calls to a person with an order of protection against him on or about October 25th and 26th of 2022 in the City of Batavia.
