GENESEE COUNTY/Indictments

James J. Santiago Jr., has been indicted and is accused of the crime of failure to register a change of address as a sex offender, a class E felony. Santiago allegedly failed to register a change of address with the NYS Division of Criminal Justice Services within the required 10 days on or about July 7, 2022 in the town of Elba.

Jarrod K. Fotiathis is facing three separate indictments. In the first indictment handed up by the Grand Jury, he is accused of identity theft second degree, a class E felony and petit larceny, after knowingly and with intent to defraud by allegedly assuming the identity of another person by presenting himself as that other person. Fotiathis allegedly used a debit card belonging to another person and made purchases in the amount of $670.77 between February 3rd and 4th 2023 in the City of Batavia. Fotiathis also allegedly stole an Amazon Firestick remote.

In the second indictment, Fotiathis is accused of two counts of grand larceny 4th degree, a class E felony, after allegedly stealing two debit cards from a person in the City of Batavia on or about November 16, 2022. He is also accused of petit larceny and conspiracy fifth degree after allegedly stealing a wallet on the same above date from the same person.

In the third indictment, Fotiathis is accused of grand larceny fourth degree, a class E felony, conspiracy fifth degree, criminal possession of stolen property fourth degree, a class E felony, petit larceny, and unlawful possession pf personal identification third degree after allegedly stealing a credit card and money from a person on or about September 2, 2022 in the City of Batavia, NY.

Isaac C. King has been indicted on the counts of criminal contempt in the first degree, a class E felony and aggravated family offense, a class E felony after allegedly repeatedly making telephone calls to person who has an order of protection against him. The incident occurred on or about December 2, 2033 in the town of Pembroke.

District Attorney Kevin Finnell accuses King of having been convicted of the crime of criminal obstruction of breathing in Genesee County on March 7, 2022, and at the time of commission of that offense, King and the person against whom the offenses was committed were members of the same family or household and such previous conviction took place within the 5-year time frame.

Beth Ann Jeffres has been indicted and is accused of the crimes of promoting prison contraband first degree, a class D felony, two counts, after knowingly and unlawfully introducing dangerous contraband, cocaine, into a detention facility at 14 West Main Street, the Genesee County Jail on or about November 26, 2022.

Jeffres is also accused of two counts of criminal possession of a controlled substance third degree, a class B felony, after knowingly and unlawfully possessing narcotic drugs, cocaine and fentanyl, with intent to sell it on the same above date and location.

Jeffres is further accused of criminal possession of a controlled substance fourth degree, a class C felony, and criminal possession of a controlled substance seventh degree in the same above incident for knowingly and unlawfully possessing cocaine with a weight of one-eighth ounce or more and knowingly and unlawfully possessing a controlled substance, Pregabalin.
