GENESEE COUNTY/Indictments

THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment, accuses the Defendant, JOSEPH G. BAUER, of the crime of DRIVING WHILE INTOXICATED, AS A MISDEMEANOR, in violation of Vehicle and Traffic Law Section 1192-3, in that he, the said JOSEPH G. BAUER, on or about the 4th day of July, 2022, in the Town of Darien, County of Genesee, State of New York, did operate a motor vehicle, to wit: a 2022 Chevrolet, on Park Road, a public highway, while he, the said JOSEPH G. BAUER, was allegedly in an intoxicated condition.
COUNT TWO:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the defendant, JOSEPH G. BAUER, of the crime of AGGRAVATED UNLICENSED OPERATION IN THE FIRST DEGREE, in violation of Vehicle and Traffic Law Section 511-3(a)(i) and (2)(a)(iii), a class E felony, in that he, the said JOSEPH G. BAUER, on or about the 4th day of July, 2022, in the Town of Darien, County of Genesee, State of New York, did operate a motor vehicle, to wit: a 2022 Chevrolet, on Park Road, a public highway, while he, the said JOSEPH G. BAUER, knew or had reason to know that his license or privilege of operating such motor vehicle in this State or his privilege of obtaining a license to operate such motor vehicle issued by the commissioner was suspended pending prosecution on a charge of a violation of Section 1192 of the Vehicle and Traffic Law and that such suspension was still in effect and at the time of such operation the Defendant was operating such motor vehicle under the influence of alcohol or a drug in violation of Subdivision 1, 2,
2-a, 3, 4, 4-a or 5 of Section 1192 of the Vehicle and Traffic Law.

THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment, accuses the Defendant, TIMOTHY W. SZURGOT, of the crime of CRIMINAL POSSESSION OF STOLEN PROPERTY IN THE THIRD DEGREE, contrary to Penal Law Section 165.50, a class D felony, in that he, the said TIMOTHY W. SZURGOT, on or about the 25th day of October, 2022, in the Town of Batavia, County of Genesee, State of New York, knowingly possessed stolen property, to wit: a 2018 Ford Focus, with intent to benefit himself or a person other than an owner thereof or to impede the recovery by an owner thereof and when the value of the property exceeded three thousand dollars.
COUNT TWO:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses I the said, TIMOTHY W, SZURGOT, of the crime of CRIMINAL IMPERSONATION IN THE SECOND DEGREE, contrary to Penal Law Section 190.25(1), a class A misdemeanor, in that he, the said TIMOTHY W. SZURGOT, on or about the
25th day of October 2022, in the Town of Batavia, County of Genesee, State of New York, impersonated another and did act in such assumed character with intent to obtain a benefit or injure or defraud another.

THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment, accuses the defendant, BRIAN N. MILES, of the crime of ATTEMPTED FORGERY IN THE SECOND DEGREE, contrary to Penal Law Sections 110.00 and 170.10(1), a class E felony, in that he, the said BRIAN N. MILES, on or about the 15th day of
November 2021, while at ESL Federal Credit Union, located at 4214 Veterans Memorial Drive, in the Town of Batavia, County of Genesee, State of New York, with intent to defraud, deceive or injure another, falsely made, completed or altered a written instrument which was purported to be or which was calculated
to become or to represent if completed, a deed, will, codicil, contract, assignment, commercial instrument, credit card or other instrument which did or may evidence, create, transfer, terminate or otherwise affect a legal right, interest, obligation or status, to wit: he attempted to fill out a check, belonging to another, for the purposes of gaining monetarily.
COUNT TWO:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, BRIAN N. MILES, of the crime of CRIMINAL POSSESSION OF A FORGED INSTRUMENT IN THE SECOND DEGREE, a class D felony, contrary to Penal Law Section 170.25, in that he, the said BRIAN N. MILES, on or about the 15th day of November, 2021, while at ESL Federal Credit Union, located at 4214 Veterans Memorial Drive, in the Town of Batavia, County of Genesee, State of New York, with knowledge that it was forged and with intent to defraud, deceive or injure another, uttered or possessed a forged instrument which is or purports to be a deed, will, codicil, contract, assignment, commercial instrument, credit card or other instrument which did or may evidence, create, transfer, terminate or otherwise affect a legal right, interest, obligation or status, to wit: a completed JP Morgan Chase check.
COUNT THREE
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, BRIAN N. MILES, of the crime of CRIMINAL POSSESSION OF STOLEN PROPERTY IN THE FIFTH DEGREE, contrary to Penal Law Section 165.40, a class A misdemeanor, in that he, the said BRIAN N. MILES, on or about the 15th day of November, 2021, while at ESL Federal Credit Union, located at 4214 Veterans Memorial Drive, in the Town of Batavia, County of Genesee, State of New York, knowingly possessed stolen property with intent to benefit himself or a person other than an owner thereof, or to impede the recovery by an owner thereof, to wit: a JP Morgan Chase checkbook.
COUNT FOUR:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, BRIAN N. MILES, of the crime of CRIMINAL POSSESSION OF A CONTROLLED SUBSTANCE IN THE SEVENTH DEGREE, contrary to Penal Law Section 220.03, a class A misdemeanor, in that he, the said BRIAN N. MILES, on
or about the 15th day of November 2021, while at ESL Federal Credit Union, located at 4214 Veterans Memorial Drive, in the Town of Batavia, County of Genesee, State of New York, knowingly and unlawfully possessed a controlled substance, to wit: Cocaine.
