Genesee Biogas LLC has requested area variances to construct six tanks for a new bio-gas plant at an existing agri-business park on W. Ag Park Drive in the Town of Batavia. Genesee Biogas is requesting two tanks at 83.5 feet and four tanks at 41 feet.
Maximum height allowed is 40 feet.
The lot where the new bio-gas plant is proposed is zoned as an Industrial Park District. The project has been approved by the Genesee County Planning Board, who has now referred the project to the Town of Batavia ZBA.
The Town of Batavia ZBA has set a Public Hearing date of June 19, 2023 at 7:00p.m., to discuss the proposal.
Last April, Genesee Biogas LLC proposed an area variance for an 81.5 height variance for property at 4800 W. Ag Park Drive Batavia, NY.
According to ZBA Chairperson John Della Penna, the ZBA denied the area variances last year because the location was close to Ellicott Street Road and would have had an impact on the neighborhood of homes there. That location was zoned agricultural/residential.
