BATAVIA/Arrest made in Walnut Street standoff – Video News Service
THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment, accuses the Defendant, ANTHONY F. ARMSTRONG, JR., of the crime of BURGLARY IN THE FIRST DEGREE, a class B violent felony, contrary to Penal Law Section 140.30(3), in that he the said ANTHONY F. ARMSTRONG, JR., on or about the 20th day of March, 2023, knowingly entered or remained unlawfully in a dwelling located at 46 Walnut Street, Upper Apt., in the City of Batavia, County of Genesee, State of New York, with intent to commit a crime therein, and when in effecting entry or while in the dwelling or in immediate flight there from, he
used or threatened the immediate use of a dangerous instrument, to wit: a serrated blade knife.
COUNT TWO:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the said, ANTHONY F. ARMSTRONG, JR., of the crime of UNLAWFUL IMPRISONMENT IN THE FIRST DEGREE, a class E felony, contrary to Penal Law Section 135.10, in that he, the said ANTHONY F. ARMSTRONG, JR., on or about
the 20th day of March, 2023, while at 46 Walnut Street, Upper Apt. , in the City of Batavia, County of Genesee, State of New York, restrained another person under circumstances which exposed the latter to a risk of serious physical injury.
COUNT THREE:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the said, ANTHONY F. ARMSTRONG, JR., of the crime of CRIMINAL POSSESSION OF A WEAPON IN THE THIRD DEGREE, a class D felony, contrary to Penal Law Section 265.02(1) in that he, the said ANTHONY F. ARMSTRONG, JR., on or
about the 20th day of March, 2023, while at 46 Walnut Street, Upper Apt„ in the City of Batavia, County of Genesee, State of New York, possessed a dangerous knife, with intent to use the same unlawfully against another.
COUNT FOUR:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the said, ANTHONY F. ARMSTRONG, JR., of the crime of MENACING IN THE SECOND DEGREE, a class A misdemeanor, contrary to Penal Law Section 120.14(1), in that he, the said ANTHONY F. ARMSTRONG, JR., on or about the
20th day of March, 2023, while at 46 Walnut Street, Upper. Apt. , in the City of Batavia, County of Genesee, State of New York, intentionally placed or attempted to place another person in reasonable fear of physical injury, serious physical injury or death by displaying a dangerous instrument, to wit: a serrated
blade knife.
COUNT FIVE:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the said, ANTHONY F. ARMSTRONG, JR., of the crime of CRIMINAL MISCHIEF IN THE FOURTH DEGREE, a class A misdemeanor, contrary to Penal Law Section 145.00(1), in that he, the said ANTHONY F. ARMSTRONG, JR., on or about the 20th day of March, 2023, while at 46 Walnut Street, Upper Apt. ,in the City of Batavia, County of Genesee, State of New York, having no right to do so nor any reasonable ground to believe that he had such right, intentionally damaged property of another person, to wit: a window.
COUNT SIX:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the said, ANTHONY F. ARMSTRONG, JR., of the crime of CRIMINAL MISCHIEF IN THE FOURTH DEGREE, a class A misdemeanor, contrary to Penal Law Section 145.00(1), in that he, the said ANTHONY F. ARMSTRONG, JR., on or about the 20th day of March, 2023, while at 46 Walnut Street, Upper Apt., in the City of Batavia, County of Genesee, State of New York, having no right to do so nor any reasonable ground to believe that he had such right, intentionally damaged property of another person, to wit: a wall by kicking a hole in it.
COUNT SEVEN:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the said, ANTHONY F. ARMSTRONG, JR., of the crime of CRIMINAL MISCHIEF IN THE FOURTH DEGREE, a class A misdemeanor, contrary to Penal Law Section 145.00(1), in that he, the said ANTHONY F. ARMSTRONG, JR., on or about the 20th day of March, 2023, while at 46 Walnut Street, Upper Apt., in the City of Batavia, County of Genesee, State of New York, having no right to do so nor any reasonable ground to believe that he had such right, intentionally damaged property of another person, to wit: a wall by stabbing multiple holes in it with a serrated blade knife.
