GENESEE COUNTY/Indictments

The Grand Jury of the County of Genesee, by this Indictment, accuses the Defendant, Dale W. Skates, Jr., of the crime of Grand Larceny in the fourth degree, contrary to Penal Law Section 155.30(1), a class E felony, in that he, the said Dale W. Skates, Jr., on or about the 16th day of November, 2022, while at Home Depot located at 4181 Veterans Memorial Drive, in the Town of Batavia, County of Genesee, State of New York, did steal property having a value exceeding one thousand dollars.

The Grand Jury of the County of Genesee, by this Indictment, accuses the Defendant, Chad W. Main, of the crime of Driving While Ability Impaired by Drugs, a class E felony, contrary to Vehicle and Traffic Law Sections 1192(4) and 1193(1)(c)(i), in that he, the said Chad W. Main, on or about the 2nd day of December 2022, in the Town of LeRoy, County of Genesee, State of New York, did operate a motor vehicle, to wit: a 2005 Chevrolet Colorado, on Parmalee Road, a public highway, while his ability to operate such motor vehicle was impaired by drugs.
COUNT TWO:
And The Grand Jury Aforesaid, by this Indictment, further accuses the Defendant, Chad W. Main, of the crime of Aggravated Unlicensed Operation of a Motor Vehicle in the first degree, a class E felony, contrary to Vehicle and Traffic Law Section 511-3(a)(i), in that he, the said Chad W. Main, on or about the 2nd day of December, 2022, in the Town of LeRoy, County of Genesee, State of New York, did operate a motor vehicle, to wit: a 2005 Chevrolet Colorado, on Parmalee Road, a public highway, while he, Chad W. Main, was under the influence of alcohol or a drug in violation of subdivision l, 2, 2-a,
3, 4, 4-a or 5 of Section 1192 of the Vehicle and Traffic Law and while knowing or having reason to know that his license to operate such motor vehicle In this state was suspended or revoked, and the suspension or revocation was based upon a conviction for a violation of any of the provisions of Section 1192 of the Vehicle and Traffic Law.
COUNT THREE:
And The Grand Jury Aforesaid, by this Indictment, further accuses the Defendant, Chad W. Main, of the crime of Criminal Possession of a Controlled Substance in the fifth degree, a class D felony, contrary to Penal Law Section 220.06(5), in that he, the said Chad W. Maiin, on or about the 2nd day of December 2022, in the Town of LeRoy, County of Genesee, State of New York, knowingly and unlawfully possessed a controlled substance, to wit: cocaine, and said cocaine weighed five hundred milligrams or more.
COUNT FOUR:
And The Grand Jury Aforesaid, by this Indictment, further accuses the Defendant, Chad W. Main, of the crime of Criminal Possession of a Controlled Substance in the seventh degree, a class A misdemeanor, contrary to Penal Law Section 220.03, in that he, the said Chad W. Main, on or about the 2nd day of December 2022, in the Town of LeRoy, County of Genesee, State of New York, knowingly and unlawfully possessed a controlled substance, to wit: methamphetamine.

Special Information

Kevin T. Finnell, District Attorney of Genesee County, hereby accuses Chad W. Main, of having been convicted of the crime(s) of Driving While Intoxicated, PER SE, a class E felony, contrary to Vehicle and Traffic Law Section 1192(2), on or about the 27th day of April, 2017, in County Court, County of
Wyoming, State of New York and said conviction was within ten years previous to the commission of the crimes alleged in the Indictment filed herewith and such conviction forms the basis for the suspension or revocation referred to in Count Two of the Indictment filed herewith, and, at the time when he committed the crimes alleged in the Indictment herein, he the said, Chad W. Main, knew or had reason to know: (1) of the existence of the aforesaid prior conviction, (2) that his license or his privilege of operating a motor vehicle in this State or his privilege of obtaining a license issued by the Commissioner was suspended or revoked as a result of said conviction and (3) that such suspension or revocation was still in effect.

The Grand Jury of the County of Genesee, by this Indictment, accuses the Defendant, Isaac D. Abrams, of the crime of Robbery in the second degree, contrary to Penal Law Section 160.10(1), a class C violent felony, in that he, the said Isaac D. Abrams, on or about the 10th day of March, 2023, while at the Honey Pot Dispensary located at 7169 Poodry Road, in the Town of Alabama, County of Genesee, State of New York, did forcibly steal property, to wit: a safe and U.S. currency, when aided by another person actually present.

The Grand Jury of the County of Genesee, by this Indictment, accuses the Defendant, Matthew M. Keiffer, of the crime of Burglary in the third degree, contrary to Penal Law Section 140.20, a class D felony, in that he, the said Matthew M. Keiffer, on or about 16th day of March, 2022, knowingly and unlawfully entered into a building, to wit: Ideal Burial Vision, located at 1166 Vision Parkway, in the Town of Pembroke, County of Genesee, State of New York, with intent to commit a crime therein.
COUNT TWO:
And The Grand Jury Aforesaid, by this Indictment, further accuses the said, Matthew M. Keiffer, of the crime of Grand Larceny in the fourth degree, contrary to Penal Law Section 155.30(4), a class E felony, in that he, the said Matthew M. Keiffer, on or about the 16th day of March, 2022, while at Ideal Burial Vision, located at 1166 Vision Parkway, in the Town of Pembroke, County of Genesee, State of New York, did steal property which consisted of a credit card, to wit: an American Express card.
COUNT THREE:
And The Grand Jury Aforesaid, by this Indictment, further accuses the said, Matthew M. Keiffer, of the crime of Grand Larceny in the fourth degree, contrary to Penal Law Section 155.30(4), a class E felony, in that he, the said Matthew M. Keiffer, on or about the 16th day of March, 2022, while at Ideal Burial Vision, located at 1166 Vision Parkway, in the Town of Pembroke, County of Genesee, State of New York, did steal property which consisted of a credit card, to wit: a second American Express card.
COUNT FOUR:
And The Grand Jury Aforesaid, by this Indictment, further accuses the said, Matthew M. Keiffer, of the crime of Criminal Mischief in the third degree, contrary to Penal Law Section 145.05(2), a class E felony, in that he, the said Matthew M. Keiffer, on or about the 16th day of March, 2022, while at Ideal Burial Vision, located at 1166 Vision Parkway, in the Town of Pembroke, County of Genesee, State of New York, with intent to damage property of another person, and having no right to do so nor any reasonable ground to believe that he had such right, he damaged property of another person in an amount exceeding two hundred and fifty dollars, to wit: a window.
