On September 10, 2023, at approximately 9:04p.m., the Wyoming County Sheriff’s Office responded to the report of a pickup truck and motorcycle involved in a collision on Route 20A in the
Town of Sheldon.
Upon arrival, it was determined that Gary S. Konfederath, 40, of Varysburg, NY, was operating a 2016 Chevrolet Silverado southbound from a driveway and pulled straight out into the westbound lane of Route 20A, directly into the path of an oncoming 2003 Suzuki motorcycle.
The motorcycle struck the driver’s side of the 2016 Chevrolet, causing serious injuries to the motorcycle operator. The motorcycle operator was flown by Mercy Flight to Erie County Medical Center [ECMC] for multiple serious injuries and remains under care in the ECMC Trama Intensive Care Unit.
While investigating at the scene, Wyoming County Sheriff’s Deputies observed Konfederath exhibiting general indicators of impairment. Konfederath was transported to the Wyoming County Community Health System Emergency Room, where he refused to submit to a chemical test.
A search warrant was applied for by Deputies with a Wyoming County Court Judge, and a
Compulsory Blood Order was issued to forcefully obtain a blood sample.
A blood sample was secured from Konfederath following the issuance of the warrant, and he was
then charged with vehicular assault in the second degree, a class E Felony, driving while intoxicated, reckless driving, and failure to yield right of way entering the roadway.
Konfederath was arraigned in Warsaw Village Court where his license was suspended pending prosecution, and he was then released on his own recognizance in compliance with
NYS Bail Reform.
Konfederath is scheduled to reappear in court on September 18, 2023 in Sheldon Town Court.
