WYOMING COUNTY/Gainesville man indicted and charged with Course of Sexual Conduct Against a Child

On November 29, 2023, Robert L. Evans of Gainesville, NY was arraigned on an indictment charging him with one count of Course of Sexual Conduct Against a Child in the Second Degree, a class D violent felony.

Based upon the fact that Mr. Evans has a prior felony child abuse conviction out of the state of Virginia, the maximum sentence he faces on this new indictment is 7 years in prison followed by up to 15 years of Post Release Supervision.

The allegation within the indictment are that Mr. Evans, during the time frame of August 24, 2017 and May 1, 2023, engaged in two or more acts of sexual conduct with a child who at that time of the alleged criminal acts was less than 11 years old.

This indictment stems from an 8-month investigation led by members of the Wyoming County Sheriff’s Department and members of the Wyoming County Child Protective Services.

During the arraignment before the Hon. Michael M. Mohun, Mr. Evans was held on $15,000 cash bail, $30,000 bond and $50,000 partially secured bond. This matter was set for a conference on December 21, 2023 at 10:30 a.m. and the matter was also adjourned to January 25, 2024 at 2 p.m. for oral argument on motions.
