WYOMING COUNTY/Registered level 2 sex offender charged after failing to comply with the Sex Offender Registration Act

On February 13, 2024, Elijah E. Albano, 43, of Buffalo, NY, formerly of Bennington NY, was arrested and charged with a class E felony for failing to comply with the Sex Offender Registration Act (Corrections
Law Section 168).

Albano is alleged to have failed to appear at the Wyoming County Sheriff’s Office to provide an updated photo, and he is also alleged to have failed to register a new address.

Albano was convicted in 2009 on two counts of criminal sexual act 3rd degree/victim less than 17 years old.
Albano was arraigned in Warsaw Village Court and released on his own recognizance in accordance with NYS bail reform laws. He is scheduled to appear in Warsaw Village Court on March 4, 2024.

The Sex Offender Act requires all convicted sex offenders living in New York to register their address with the local police department where they live. Additionally, convicted sex offenders are required to do a mail in verification annually with New York State Division of Criminal Justice Services. They are also required to present themselves at the police department for whom they are registered for updated photographs.

Level 1 and Level 2 offenders must have their photograph taken every three years, and Level 3 offenders must have their photograph taken every year. Level 3 offenders are additionally required to appear in person at their police department every ninety days for an in-person verification.
