PERRY POLICE REPORT/Driver fails to pull over for police, facing a felony drug charge

On March 11, 2024, The Perry Police Department attempted to conduct a traffic stop on a vehicle on Standpipe Road. The vehicle failed to pull over, turning into a field laneway. The vehicle ultimately came to a stop on Embury Avenue in the Town of Castile.

Upon stopping the vehicle, Officers met with the vehicle operator Colin McMurtry, 41, of Castile, NY. A license check revealed McMurtry to be operating the vehicle with a suspended non-driver ID and had 12 suspensions on 5 separate dates. McMurtry allegedly had several drug paraphernalia items on his person and in plain view inside his vehicle.

A search of the vehicle McMurtry was operating revealed several alleged baggies of a rocky white substance. The substance was later identified as crack cocaine.

McMurtry was charged with aggravated unlicensed operator in the second degree, operating a vehicle without a license, and failure to comply with a lawful order. McMurtry was also charged with the felony offense, criminal possession of a controlled substance in the 5th degree.

McMurtry was issued an appearance ticket to appear in Perry Village Court on April 16, 2024 at 1:00p.m.
