GENESEE COUNTY SHERIFF’S REPORT/April 10, 2024

On April 2, 2024, The Genesee County Sheriff’s Office responded to the Target parking lot in the Town of Batavia, for the report of two people slumped over in a vehicle.

Following an investigation, it is alleged that the two occupants in the vehicle, David B. Eck Jr., 31, of Attica, NY, and Ashley J. Rzemek, 29, of Lancaster, NY, possessed cocaine. Eck Jr. also allegedly possessed fentanyl and buprenorphine/suboxone.

While in custody, Eck Jr. allegedly ate a quantity of a suspected narcotic in attempt to conceal it.

David B. Eck Jr. is charged with tampering with physical evidence, a class E felony, and 3 counts of criminal possession of a controlled substance 7th degree, a misdemeanor.

Ashley J. Rzemek, is charged with 3 counts of criminal possession of a controlled substance 7th degree, a misdemeanor.

Both Eck and Rzemek were released on appearance tickets and will appear in the Town of Batavia Court on April 23, 2024 at 3:00p.m.

Assisting in the investigation, Deputy Ewert, Deputy Blankenberg, and Deputy Kipler.

On April 5, 2024, a traffic stop was conducted in the area of Park Road in the Town of Batavia, the vehicle was being operated by Donald Ryan, 40, of Pembroke. Upon further investigation, it was discovered that Ryan, and his two passengers, Brandi Hough, 28, of Elba, NY, and Eddie Miles, 52, of Batavia, NY, allegedly possessed a controlled substance.

During the investigation, Ryan and Hough attempted to conceal drug paraphernalia from deputies.

The Genesee County Sheriffs Office arrested:

Donald Ryan, 40, Pembroke, NY, on the following charges:
-Tampering with Physical Evidence, an E Felony
-Criminal Possession of a Controlled Substance 7th Degree (2 Counts) — A Misdemeanor and NYS Vehicle and Traffic Law/ Failure to signal

Brandi Hough, 28, of Elba NY, on the following charges:
-Tampering with Physical Evidence, an E Felony
-Criminal possession of a Controlled Substance Degree (2 Counts) — A Misdemeanor

Eddie Miles., age 52, West Main Street Road, Batavia NY, for the following charges
-Criminal Possession of a Controlled Substance 7th Degree (2 Counts) —A Misdemeanor

Ryan, Hough and Miles were released on an appearance ticket returnable to Batavia Town Court on April 23, 2024 at 3:00pm.

Kathryn L. Reinard, 29, of Pensacola, Florida, is charged with criminal trespass 2nd degree after allegedly knowingly entering and remaining unlawfully in a dwelling located in the Town of Pembroke on Main Road on April 5, 2024.

Reinard was transported to the Genesee County Jail for processing and appeared in CAP Court on April 5, 2024 at 8:00p.m.

Joel Morales-Cruz, 49, of Batavia, NY, is charged with DWI/previous conviction, driving with a BAC of .08% or more/previous conviction, circumventing an interlock device, aggravated unlicensed operation 1st degree and failure to stop at a stop sign, after a traffic stop for a moving violation on Park Road on April 7, 2024 at 2:36a.m.

Morales-Cruz was allegedly operating a vehicle while intoxicated deputies say.

Morales-Cruz was released on traffic tickets returnable to Batavia City Court.

Jose A. Morales, 46, of Pavilion, NY, is charged with DWI, moving from a lane unsafely and driving to the left of pavement markings, after a motor vehicle accident on Perry Road in Pavilion on April 8, 2024 at 5:49p.m.

Morales was located off the east shoulder of the roadway and was allegedly intoxicated by alcohol.

Morales was arrested and transported to the Genesee County Jail for processing. He was held for CAP Court arraignment on April 9, 2024 at about 7:00a.m.

Donald J. Cecere Jr., 66, of Batavia, NY, is charged with DWI, driving with a BAC of .08% or more, aggravated unlicensed operation of a vehicle 3rd degree and speeding in a zone, a violation, on April 4, 2024 at 11:54p.m. on West Main Street Road in the Town of Batavia.

Deputies say Cecere Jr. was allegedly intoxicated by alcohol.

Cecere Jr. was arrested and transported to the Genesee County Jail for processing and released with uniform traffic tickets. He will appear in the Town of Batavia Court on April 25, 2024 at 1:00p.m.

Matthew G. Raffel, 20, of LeRoy, NY, is charged with DWI, driving with a BAC of .08% or more/alcohol, no tail lamps and no head lamps, on March 22, 2024 at 11:37p.m. on East Main Street in the City of Batavia.

Raffel will appear in Batavia City Court on April 11, 2024 at 1:30p.m.

Matthew O. Bader, 41, of Batavia, NY, is charged with identity theft 3rd degree//assuming another person’s identity to obtain goods, and criminal possession of stolen property 5th degree, after a complaint on Veteran’s Memorial Drive on March 15, 2024 of a stolen credit card.

Bader allegedly stole the credit card and used it to make purchases in the City of Batavia and the Town of Batavia.

Bader was transported to the Genesee County Jail and will appear in Batavia Town Court on April 9, 2024 at 3:00p.m.

Terrance L. Falk, 25, of Batavia, NY, is charged with harassment 2nd degree after a physical argument at the Jail at 14 West Main Street on April 6, 2024 at 4:10p.m.

Falk allegedly was involved in a physical altercation with another person.

He was issued an appearance ticket and will appear in Batavia City Court on April 17, 2024 at 1:00p.m.
