Henry L. Banks appeared in Genesee County Court on Wednesday afternoon with his attorney Steven M. Cohen, a Criminal and Civil attorney out of Buffalo, for further proceedings.
Banks, 55, of Batavia, was arrested on a sealed indictment warrant on charges of Criminally Negligent Homicide, a class E felony, and three counts of Endangering the Welfare of a Child, a class A misdemeanor on April 4th, 2025. Banks was arraigned in Genesee County Court and originally held on $25,000 cash bail, $50,000 bond bail and $75,000 equity bail. He is currently out on bail.
First Assistant District Attorney, Joseph J. Robinson, informed Judge Melissa Lightcap Cianfrini that the people are ready for trial and all discovery materials have been forwarded to Mr. Cohen as of Wednesday April 23rd, 2025.
Cohen confirmed receipt of the discovery file but had questions about an outstanding search warrant and Grand Jury testimony from a witness.
First Assistant DA Robinson confirmed all Grand Jury testimony was turned over with discovery materials and that the outstanding search warrant is still awaiting information to be formatted from a cell/telephone provider so it can be sent over.
Due to Mr. Cohen’s other obligations in Erie County, the dates for motions and oral arguments were moved back a bit. Motions are set for June 9th with responses on June 16th and Oral Argument are tentatively scheduled for June 30th at 11:00am, pending District Attorney Kevin Finnell’s schedule
