Provided letter to the NYS Office of Cannabis Management:

As the City Manager of Batavia, I am writing to express my formal opposition to the proposed
establishment of a cannabis drive-through dispensary at 230 W. Main Street Batavia, NY 14020.
While the State of New York has legalized the sale and use of recreational cannabis, municipalities retain
a responsibility to ensure that such businesses are integrated into our communities in a manner that
prioritizes public health, safety, and the overall character of our neighborhoods. After careful
consideration, I believe that a drive-through model for cannabis distribution raises significant concerns
that are inconsistent with these priorities.

First and foremost, the drive-through format presents heightened risks to public safety. Allowing
individuals to purchase cannabis without leaving their vehicles diminishes the opportunity for meaningful
customer screening, responsible service, and proper education on usage and legal limits. This model could inadvertently encourage consumption in vehicles, increase the potential for impaired driving, and pose enforcement challenges for local law enforcement agencies.

Secondly, the proposed location and format raise concerns about compatibility with surrounding land
uses. Drive-through dispensaries are likely to generate higher volumes of traffic and congestion, which
may negatively impact nearby residential areas and small businesses. Additionally, the potential for
loitering, increased odor, and late-night activity may disrupt the quality of life for nearby residents.

Batavia has worked diligently to encourage thoughtful, community-oriented development. We have an
obligation to maintain a careful balance between economic opportunity and the well-being of our citizens.
While we recognize the potential for revenue generation from cannabis-related businesses, we believe that such establishments must be held to high operational and locational standards—particularly when it comes to retail models that reduce oversight and increase public risk.

For these reasons, I respectfully recommend that this proposal not move forward. I remain committed to
supporting responsible cannabis businesses that align with New York State laws, promote public safety,
and contribute positively to our city’s long-term development goals.

Thank you for your attention to this matter and your continued efforts to protect and enhance the quality
of life in Batavia.

Sincerely,
Rachael J. Tabelski
City Manager

Note:

Several weeks ago, Video News Service attempted to speak to the owner of the business, who was not on location at 230 West Main Street at the time. A worker on site was provided with a phone number and email address to contact Video News Service about their plans for the business. The owner has not contacted Video News Service for an interview at this time.

One Comment:

  1. A very bad mistake to shut down a business in Batavia especially one that can actually generate revenue and bring in actually more community people .the table is always been a thumper for cannabis recreational use here and I think it’s time to get the city councilor and management off the board and get somebody else more open-minded
