City of Batavia and Savarino move forward on Ellicott Station commercial and residential projects

Sam Savarino and his attorney Daniel Bobbett appeared in City Housing Court before Judge Durin Rogers on Monday afternoon at the Genesee County Courthouse, to provide and update and timeline on the residential and commercial projects at Ellicott Station.

During the appearance, Judge Rogers asked both sides if any progress has been made on 56- 50 Ellicott Street, which is the residential project, and 40- 52 Ellicott Street, which is the commercial project (the former Della Penna building).

Bobbett told the court that of the 12 violations, only two remain incomplete, which will be completed upon occupancy. City of Batavia Attorney, David Fitch says the City plans to withdraw the (2) remaining violations and further court appearances are not needed.

Bobbett says the substantial completion date for the residential project is March 20th, 2026, which is subject to weather.

The commercial project also has moved forward; Savarino will submit a new plan and new application along with architectural plans this year. Savarino’s attorney says in April of 2026 it will be an occupied site and by late 2026 the commercial project will be completed. Fitch told the Judge there are no urgent safety issues on the commercial site and that the building has been secured to keep people out.

Once the application process is completed for the commercial process, work can start in about three weeks, weather permitting.

“We’re very encouraged, says Fitch. I think we’re in lockstep and certainly by the end of the calendar year these issues will be resolved.”

The matter was adjourned until April 20th for an update.
