On February 12, 2026, at 2:50 P.M., Troopers out of SP Batavia responded to West Main Street and Kelsey Road in the town of Batavia for a vehicle collision.
An Investigation determined that a 1983 Mercury Marquis operated by Thomas J. Luby, 46 (corrected age NYS Police), of Elba, NY, was traveling eastbound on West Main Street and crossed the centerline, striking a 2013 Toyota 4-Runner.
Luby was transported to Erie County Medical Center with life-threatening injuries. The operator of the 4-Runner had no injuries. While being treated at ECMC, Luby succumbed to his injuries.
This is an active investigation.
The NYSP Bureau of Criminal Investigation is assisting with this investigation.
