Perry, NY – Chief Michael J. Grover reports the arrest of Joshua C. Rosenberg, 28, of Wyoming, NY.
On May 15, 2026, the Perry Police Department responded to a complaint of a possibly intoxicated individual leaving a parking lot. While responding, officers observed the suspect vehicle exiting a school parking lot and initiated a traffic stop at the intersection of Benedict Avenue and Watkins Avenue.
Upon making contact with the driver, officers suspected that Rosenberg was allegedly operating the vehicle while intoxicated. Rosenberg was asked to perform standardized field sobriety tests, which he performed poorly. As a result, Officer David Spink placed Rosenberg under arrest and charged him with Driving While Intoxicated (DWI).
Rosenberg was transported to the Perry Police Department, where a chemical breath test revealed a blood alcohol content (BAC) of 0.34%.
Further investigation determined that a child under the age of 16 was present in the vehicle at the time of operation. Rosenberg was subsequently charged with Driving While Intoxicated and Aggravated Driving While Intoxicated (BAC of 0.18% or higher), both misdemeanors, as well as one felony count of Driving While Intoxicated with a Child in the Vehicle (Leandra’s Law).
Rosenberg was arraigned in Perry Village Court before the Honorable Tammy Kelsey and was released on his own recognizance, as the charges are not bail-qualifying offenses. His driver’s license was suspended pending prosecution and is scheduled to return to Perry Village Court on June 9, 2026.
