Carolina Eastern Crocker is planning to add a fertilizer product storage building to its site at 8610 Rt. 237. The Project proposes the construction of a 140’x80’x18’, 11,200 square foot fully enclosed storage pole barn for the purpose of storing fertilizer
products and equipment at its Stafford Facility.

NOTICE OF PUBLIC HEARING

Notice is hereby given that the Town of Stafford Planning Board will hold a Public Hearing on Wednesday, September 23, 2026 at 7:00 PM at the Stafford Town Hall 8903 Route 237, Stafford, NY to discuss the application of Carolina Eastern Crocker’s request for a Site Plan Approval to build a 140’ x 80’ storage barn for storing fertilizer and machinery at 8610 Route 237, Stafford, NY, per Article IV Section 182-27 of the Town Zoning Code. Said Planning Board will convene at the time stated above to hear from all persons in connection with such matters. By order of the Stafford Planning Board, William VanAlst, Chairman

According to an August 3rd letter sent to the Town of Stafford by attorneys representing Carolina Eastern Crocker, the Project is situated in the southwestern portion of the Carolina Eastern Crocker property and west of an existing metal storage building. The proposed storage pole barn will have a setback of approximately 114 feet from the nearest adjacent property line.

Carolina Eastern Crocker is located in the Agriculture Residential zoning district.

Attorneys for Carolina Eastern Crocker say the proposed project is a permitted use under a special use permit that was granted by the town in 1990, as Carolina Eastern Crocker was determined to be an agriculture-based business according to Town Code § 182-5.

On March 12, 2026, Carolina Eastern Crocker submitted a petition to Stafford Town Board to request adoption of a text amendment to Town Code § 182-33(B) to clarify that certain setbacks established there do not apply to agriculture-based businesses operating pursuant to a special use permit (“Petition”).

The Planning Board issued a recommendation on the Petition on May 27, 2026. Carolina Eastern Crocker submitted correspondence dated June 8, 2026 to the Town Board and Planning Board to respond to the Planning Board recommendation and attended the Town Board meeting on that same date in further support of the Petition. The Town Board tabled its review of the Petition and referred the matter back to the Planning Board for further consideration at the Planning Board’s June 24, 2026 meeting where the Planning Board took no further action.

“We understand that the Town Board considered the Petition further at its meeting on July 13, 2026. The Project is required for CEC to continue a successful and operational business at its Stafford Facility, and we submit this Letter of Intent (“LOI”) with supporting documentation as CEC’s site plan application (“Application”) to the Planning Board to explain the Project and demonstrate its compliance with all applicable Town Code requirements,” says Matthew J. Fitzgerald, Esq. of Phillips Lytle LLP

“We respectfully request that the Town Board stay any further consideration of the Petition until the Planning Board issues a decision on the Application. Furthermore, we respectfully request that the Town Code Enforcement Officer (“CEO”) acknowledge
that a variance is not required because the Project is in compliance with the 100-foot setback requirement established in Town Code § 182-33(B), and therefore, even if that provision applied to CEC’s use (it does not for the reasons set forth in the Petition and per CEC’s correspondence to the Town Board dated June 8, 2026), the Project is in full compliance with the Town’s Code and no variance relief or other interpretation is required for the Planning Board to complete its review of the Application.”

The proposed storage pole barn will be fully enclosed and comprised of a painted steel roof with a low-emissivity underlay, and a painted steel siding with house wrap and a two-foot clean panel under the eaves of the roof. The proposed storage pole barn will also include 12” vented overhangs located along the top perimeter of the storage pole barn.

Attorneys for Carolina Easter Crocker say the Project will be harmonious with the existing adjacent uses as it proposes a fully enclosed and properly ventilated storage pole barn that has steel siding to shield and cover any stored fertilizer products and equipment.

“The proposed storage pole barn will be painted to blend in with the existing color scheme of the other existing structures on the
Site. The Site is located within the A-R District and surrounded by mostly other agricultural uses. There are two residential properties located adjacent to the Site; however, CEC has worked with the residents there to resolve their concerns previously expressed in connection with the 2024 Site Plan Application. Accordingly, the Project will be harmonious with the surrounding
area and not interfere with existing adjacent uses.”

It appears that the two homes nearby are now vacant and residents no longer occupy the homes referred to above.

At the September 10th, 2026 County Planning Board meeting, the application and Site Plan Review to construct a new 11,200 sq. ft. (80 x 140 ft.) dry fertilizer storage building at the existing agri-business facility 8610 Route 237, Stafford was approved with the following recommendation.

[The proposed fertilizer storage building should pose no significant county-wide or inter-community impact. It is
recommended that the Town contact the Fire Department for their comments on this application and to alert them
of the presence of this building and its contents.]
