BATAVIA POLICE REPORT/Four arrested for soliciting without a permit

Officers Frank Klimjack and Kevin Defelice responded to the area of 400 East Main street for the report of subjects soliciting for cellular service on May 5, 2017.

During the investigation, it was discovered that the solicitor’s employees did not have permits issued by the City of Batavia Clerk’s Office.

Four employees, Corey Green, 22, of Smith St., Warwick, RI, Sean Goncalves, Bala G. Belmiro and Fernando Campos Rolden were arrested and charged with soliciting without a permit.

All four were arraigned in City Court and pleaded guilty. They were fined $150.00. All for were then released.

 

 

Darrell D. Smith, 50, of Bank St., Batavia, is charged with coercion 1st, unlawful imprisonment 1st, menacing 2nd, criminal mischief 4th and criminal tampering after a disturbance on Hutchins street on May 6, 2017.

Smith was arraigned in City Court and held on no bail.

 

Joseph B. James, 36, of Highland Park, Batavia, is charged with assault 2nd, criminal mischief 2nd, criminal mischief 4th, resisting arrest and harassment 2nd after an incident at on Columbia avenue on May 7, 2017.

James was jailed on no bail until his next court appearance on May 8, 2017.

 

 

Danielle M. Rozell, 36, of West Main St., Batavia, is charged with DWI after a report of a possibly intoxicated female operating a vehicle at a gas station at 204 West Main street on May 7, 2017.

Rozell was transported to Batavia Police Headquarters where she was processed and issued uniform traffic tickets for DWI.

She will appear in City Court on May 24, 2017 at 9:00a.m.

 

 

Matthew H. DeLosh, 26, of S. Swan St., Batavia, is charged with DWI, driving with a BAC of .08% or more and aggravated unlicensed operation 1st after a traffic stop on Ellicott street on May 8, 2017.

After further investigation, it was discovered that Delosh’s driving privilege was previously suspended for a prior alcohol related offense.

Delosh was arraigned in City Court and released under supervision of Genesee Justice. He will re-appear at a later date.

 

Amar SM Zainelabdin, 29, homeless, was located by the Erie County Sheriff’s Office on May 5, 2017 and turned over to the Batavia Police on a City Court arrest warrant for failing to appear on an appearance ticket.

Zainelabdin was arraigned in City Court and released on recognizance and will re-appear at a later date.

 

Mary K. Shaffer, 38, of State St., Batavia, is charged with harassment 2nd after a domestic incident where Shaffer is accused of hitting another person in the face on May 5, 2017 at a residence on State street.

Shaffer was issued an appearance ticket and will appear in City Court on May 16, 2017.

 

Justin W. Bird, 28, of Ross St., Batavia, is charged with unlawful possession of marijuana after an investigation into a complaint on West Main street on May 7, 2017.

Bird was allegedly found to be in possession of marijuana and was issued an appearance ticket and released. He will appear in court on May 16, 2017.

 

Jared D. Elliott, 19, of Keeney Rd., LeRoy, is charged with unlawful possession of marijuana after a traffic stop at 412 East Main street on May 11, 2017.

Elliott was issued an appearance ticket and released. He will appear in City Court on May 23, 2017
