BATAVIA POLICE REPORT/Columbia avenue man also charged in stabbing and beating of man on East Main street last week

Anthony Spencer Jr., 26, of Columbia Ave., Batavia is charged with gang assault and assault 1st after a male was stabbed and beaten behind the residence at 318 East Main street on July 18, 2017.

Spencer was allegedly involved in the assault and was arraigned in City Court on July 20, 2017 and held without bail.

He will re-appear in City Court on July 25, 2017 at 11:00a.m.

Last week JW Hardy III, 30, of Liberty street, Batavia, was charged with assault 1st and gang assault 1st in the stabbing/ beating incident.

The victim suffered a severe laceration to his upper arm and a tourniquet was applied until EMS arrived. The victim was also beaten after being stabbed.

The victim was transported to Strong Hospital by Mercy Flight with serious injuries.

A 15 year old was petitioned to Family Court on a unlawful possession of a weapon charge after an incident on Holland avenue on June 6, 2017.

Police were called to Holland and Olyn avenue for several people fighting in the street. After police arrived they discovered at least one person had been shot with a BB gun.

While on scene another fight broke out and three other people were charged. Lionel J. Anderson Sr, 45, of Oak St., Batavia, was arrested for disorderly conduct. Jaequele M. Tomlin, 22, of E. Main St., was arrested for disorderly conduct, attempted assault, obstructing governmental administration 2nd and resisting arrest. A 16 year old was also arrested for  criminally using drug paraphernalia 2nd.

The 15 year old is the the person who shot the BB gun in the incident.

One person was injured from the BB gun shot and was treated at UMMC.

 

 

David L. Andrews, 29, of State St., Batavia, is charged with failing to keep right, operating a vehicle while using a portable electronic device, aggravated unlicensed operation 2nd and obstructing governmental administration 2nd after a traffic stop at 432 East Main street on July 19, 2017.

Andrews allegedly fled on foot during the traffic stop, but was apprehended a few minutes later by the Batavia Police and Genesee County Sheriff Deputies.

Andrews was pulled over after failing to keep right and using a mobile device while operating a motor vehicle.

He also had a warrant out of City Court for traffic offenses and was also operating on a suspended license.

Andrews was arraigned in City Court and released on recognizance on the warrant and was then jailed on $2,500 cash or bond bail on the other charges relating to the traffic stop.

He will re-appear in court on July 27, 2017 at 11:00a.m.

 

 

Joseph M. Franchi-Platten, 33, of Dellinger Ave., Batavia, is charged with criminal possession of a controlled substance 7th, criminal use of drug paraphernalia 2nd, possession of burglar tools and tampering with physical evidence after an investigation into a trespass complaint at a local business at 103 Lehigh avenue on July 18, 2017.

Franchi-Platten was taken into custody and arraigned in City Court and then ordered to be held at the Genesee County Jail in lieu of $20,000 cash bail and $40,000 bond bail. He appeared in City Court on July 20, 2017.

 

 

Morgan L. Cox Sr., 49, of Dellinger Ave., Batavia, is charged with criminal mischief 4th after police were called to a residence on Dellinger avenue on July 22, 2017 for a male subject who was banging on a door with a cane.

Cox was taken into custody and arraigned in the Town of Batavia Court and will re-appear in court on July 25, 2017 at 1:30p.m., he was then jailed.

 

 

Morgan L. Cox Jr., 25, of Xavier St., Clarence was arrested on a bench warrant issued by City Court on July 20, 2017 at the jail.

He allegedly violated the terms of his release.

Cox Jr. was arraigned in City Court and jailed on $2,500 cash or bond bail and will appear in City Court again on July 27, 2017.

 

 

Clifford F. Schultz, 51,  of Bank St., Batavia, is charged with harassment 3nd after he allegedly threatened another person at 130 Bank street on July 18, 2017.

Schultz was issued an appearance ticket and will appear in City Court on July 25, 2017 at 1:00p.m.

 

Patricia C. Pozotempan, 36, of Masse Pl., Batavia, is charged with petit larceny and endangering the welfare of a child after a shoplifting complaint at Tops Supermarket on July 19, 2017.

Pozotempan was issued an appearance ticket and will appear in City Court on July 25, 2017 at 1:00p.m.

 

 

Donnie D. Armstrong Jr., 20 , of N. Spruce St., Batavia, is charged with petit larceny and criminal possession of stolen property 5th after he allegedly stole a bicycle from the bike rack that belonged to another person at the Richmond Library on July 19, 2017.

He was later located by police in possession of the stolen bike.

Armstrong was issued an appearance ticket and will appear in City Court on July 25, 2017 at 1:00p.m.

 

Nicholas C. Doell, 26, homeless, of Batavia, is charged with trespass after a trespass investigation at a local business at 99 Jackson street on July 19, 2017.

Doell was issued an appearance ticket and was released.

He will appear in City Court on July 25, 2017.

 

Nicholas D. Martino, 36, of Main St., Alexander, turned himself in at Batavia Police headquarters on an active bench warrant issued out of City Court on a failure to appear charge from February of 2017.

Martino posted bail and will appear in Court on July 25, 2017.
