Russell L. Penepent, 54, of West Main St.Rd., Batavia, is charged with menacing 2nd and endangering the welfare of a child after allegedly menacing a neighbor and his 5 year old son with a firearm at 4016 W. Main Street Road on September 10, 2017 at 3:20p.m
Penepent was arraigned in the Town of Batavia Court and jailed in lieu of $2,500 cash and $5,000 bond bail.
He will re-appear in court on September 22, 2017.
Ryan P. Isham, 26, of 66th St., Niagara Falls, NY, is charged with felony DWI, previous conviction within 10 years, failure to yield the right of way on a left turn and failure to yield the right of way at a yield sign after a two vehicle accident on Rt. 98 near Rt. 262 in Elba on September 10, 2017 at 12:55 a.m.
When deputies arrived on scene, they located a Dodge Ram pick up truck on its roof.
Occupants of both vehicles were out of their vehicles.
Isham, the operator of a Chevy Silverado, was transported ot UMMC for an evaluation and then released.
All other occupants of both vehicles were released on scene.
More charges are pending after further investigation.
Isham was issued traffic tickets and released to appear in Elba Town Court on December 13, 2017 at 6:00p.m.
Daniel J. Maus, 56, of Johnson Rd., Bergen, is charged with unlawful possession of marijuana after allegedly possessing marijuana during a traffic stop on Perry road in Pavilion on September 9, 2017 at 3:00p.m.
Maus was issued an appearance ticket and will appear in Pavilion Town Court on October 10, 2017 at 3:00p.m.
