BATAVIA POLICE REPORT/Man accused of being intoxicated drives away from burglary scene after police arrive

 

Police were called to a burglary in progress at 619 Ellicott street on October 24, 2018 at 12:08a.m., upon arrival, the suspect, Brendan D. Curry, 38, of Batavia Elba Townline Road, Batavia fled the scene in a vehicle and struck a guardrail.

The NYS Police located  Curry and his vehicle at the intersection on Webster avenue and Howard street.

After Batavia Police interviewed Curry, he was found to be allegedly intoxicated. He was arrested and charged with DWI, refusal to take a breath test, leaving the scene of a property damage accident and moving from a lane unsafely.

Curry was also charged with burglary 2nd.

He was arraigned in City Court and bail was set at $5,000 cash and $10,000 bond on the DWI charge. He was released on recognizance on the burglary 2nd charge.

Curry returned to court later in the day.

 

 

Raymond C. Cook, 48, of Jackson St., Batavia, is charged with DWI, driving with a BAC of .08% or more, aggravated unlicensed operation 3rd, failure to use designated lane and driving to the left of pavement markings after Officer McGinnis observed a vehicle traveling westbound on Main street committing numerous traffic infractions on October 28, 2018 at 12:41 a.m.

Cook was processed at the Batavia Police Department and was released on appearance tickets and will appear in City Court on October  31, 2018 at 9:00a.m.

 

 

A 17 year old male, of Oak St., Batavia, was arrested for disorderly conduct on October 28, 2018 at 131 West Main street, after entering the scene of a car accident that was actively being investigated by police and engaging in violent behavior in public with another subject. Both subjects were not involved in the accident in any way.

The 17 year old male was also charged with harassment 2nd on October 17, 2018 at 252 State street following the report that he punched and pushed a juvenile near Dwyer Stadium.

Both subjects were processed and released on appearance tickets and will appear in City Court on November 13, 2018.

 

Lindsay Goins Jr., 62, and Annie G. Stanley, 65, both of State St., Batavia, are each charged with harassment 2nd after an incident on State street that occurred on October 23, 2018.

Goins allegedly had physical contact with another person.

Both were issued appearance tickets and will appear in City Court on October 30, 2018.

 

 

Kimberly A. Showler, 53, of Ellicott St., Batavia, is charged with petit larceny after she was discovered shoplifting at Tops at 390 West Main street on October 22, 2018.

Showler was issued an appearance ticket and released. She will appear in City Court on October 30, 2018.

 

 

Brandon C. Smart, 41, of N. Pembroke Rd., Batavia, was arrested on a bench warrant for failure to appear in court on unnecessary noise charges on March 21, 2018 on Central avenue.

Smart was transported to City Court on October 26, 2018 and released on recognizance. He will re-appear at a later date.
