David J. Somerton, 36, of Kelsey Rd., Batavia, is charged with 5 counts disseminating indecent material to a minor, a felony, after an investigation into a sex offense that occurred in the Town of Batavia on Kelsey road on October 13, 2018. Somerton is now also charged with possession of obscene sexual performance by a child, a class E felony, and use of a child in a sexual performance, a class C felony.
Somerton was arraigned on November 29, 2018 in the Town of Batavia Court on the additional charges.
He is due back in the Town of Batavia Court at a later date.
