GENESEE COUNTY/Buffalo man facing a 14 count indictment after thruway pursuit that ended in Batavia

A Genesee County Grand Jury has indicted Andrew A. Said, 49, of Buffalo, on a 14 count indictment after a pursuit that started in Monroe County and ended in Genesee County with Said being apprehended in a wooded area behind a house on Kelsey road on August 3, 2018.

Troop E- Troopers responded to assist Monroe County Sheriff’s Office who were following 1997 Mercedes Benz with switched license plates that was involved in a larceny from Sears at Market Place Mall in Henrietta, NY.

Said did not stop for police and fled once emergency lights were activated. The pursuit continued onto the NYS Thruway westbound. Said’s vehicle exited the I-90 at exit 48, Batavia. Patrols attempted to block the suspect vehicle near the toll barrier. The suspect vehicle continued aggressively toward Troopers and as a result a Trooper shot his service weapon at the threat. The pursuit continued until the suspect vehicle turned into a private driveway on Kelsey Road in the town of Batavia. The suspect vehicle struck a dirt embankment and came to rest in a wooded area.

In count 1, Said is accused of the crime of attempted aggravated assault upon a police officer, a class C felony, after he attempted to cause serious physical injury with his vehicle to a police officer who was performing his official duties.

In count 2, Said is accused of attempted assault 1st, a class C felony, after attempting to cause serious physical injury to a person by using a dangerous instrument, his motor vehicle.

In count 3, Said is accused on reckless endangerment, a class D felony, after engaging in conduct that created a grave risk of death to another person.

In count 4, Said is accused of criminal mischief 3rd, class E felony, after allegedly causing damage to a NYS Police vehicle in an amount exceeding $250

In count 5, Said is accused of criminal mischief 2nd , a class D felony, after damaging a NYS Police vehicle in an amount exceeding $1,500.

In count 6, Said is accused of criminal mischief 2nd, a class D felony, after damaging a NYS Police vehicle in an amount exceeding $1500.

In count 7, Said is accused of unlawful fleeing a police officer in a motor vehicle 3rd, a class A misdemeanor, after knowing that he had been directed to stop his motor vehicle by a uniformed police officer or marked police vehicle by the activation of either lights or the lights and sirens. Said then did attempt to flee police officer vehicles at speeds that exceeded 25 miles over the speed limit.

In count 8, Said is charged with DWAI/Drugs, as a misdemeanor, after operating his 1997 Mercedes on the NYS Thruway while his ability was impaired by drugs.

In count 9, Said is accused of aggravated unlicensed operation 3rd, a misdemeanor, after operating his vehicle when he allegedly knew that his license or his privilege of obtaining a license was suspended or revoked.

In count 10, Said is accused of reckless driving as a misdemeanor after allegedly interfering with the free and proper use of a public highway and endangering users of a public highway.

In count 11, Said is accused of operating a motor vehicle with improper plates on his 1997 Mercedes.

In count 12, he is further accused of operating an unregistered motor vehicle, a 1997 Mercedes, without registering with the State .

In count 13, Said is accused of operating a motor vehicle without insurance.

In count 14, Said was allegedly operating his motor vehicle without a certificate of inspection displayed on the vehicle.
