BATAVIA/Fleeing suspect accused of fighting with a Police Officer during a traffic stop and then pulling out a BB gun, officer assisted by good Samaritan

The Batavia Police Department was requested to an address on Ellicott Street at approximately 11:22 PM on 06/04/2019 for a trespass.

Brandon Fogg, 32, of Liberty St, Batavia, NY, allegedly was on the complainant’s property and banging on the door, against the complainant’s wishes.

Fogg left the scene prior to patrols arrival.

At approximately 12:29 AM, Officer Darryle Streeter observed Fogg in the passenger seat of a vehicle being operated with an illegal tire.

Officer Streeter conducted a traffic stop with the vehicle on Cedar Street near Ellicott Street and attempted to speak with Fogg. Fogg allegedly opened the door to the vehicle and attempted to flee. Officer Streeter was able to take Fogg to the ground, where Fogg allegedly began to fight with Officer Streeter.

Fogg allegedly removed a black handgun from his pocket and tried to turn it toward Officer Streeter. An employee of a local business observed the struggle and was able to step on the wrist of Fogg which made him lose his grip on the gun. Officer Streeter was then able to take Fogg into custody.

The gun was later found to be a BB pistol.

Fogg was arrested for menacing 1st, criminal possession of a weapon 3rd, criminal possession of a weapon 4th, and obstructing governmental administration 2nd and trespass.

Fogg was arraigned in Batavia City Court and held with no bail.

Fogg is to re-appear in Batavia City Court on 06/06/2019 at 11:00 AM.
