WYOMING COUNTY SHERIFF’S REPORT/Arcade man found urinating into an empty alcoholic beverage can at the County Court House parking lot

Darel D. Tingue Jr., 29, of Arcade, NY, was located sitting in the driver’s seat of his vehicle urinating into an empty alcoholic beverage can while parked in the parking lot of the Wyoming County Court House, in the Village of Warsaw on October 3, 2019.

Two open bottles containing alcohol were located on the front passenger seat in Tingue’s vehicle. He admitted to driving from the City of Batavia to the Village of Warsaw.

Tingue was found to allegedly be intoxicated and subsequently charged with DWI, consuming alcohol in a motor vehicle, and refusal to take a breath test.

Tingue was arraigned in Warsaw Justice Court with a Public Defender present. He was remanded to the Wyoming County Jail on $5,000.00 cash bail or $10,000.00 bond.

Tingue appeared in Warsaw Court on October 7, 2019 to answer to the charges.

The Wyoming County Sheriff’s Office was requested to the Arcade Valley Estates for a physical domestic incident in progress on September 30, 2019. Once on location, it was found that Ashley Rebecca N. Besse, 21, of Glenwood, NY, struck and kicked people during a physical domestic incident.

Also during the incident,. Besse was holding a small child while striking the other people at the scene.

Besse was arrested for harassment 2nd and endangering the welfare of a child. She was arraigned in the Town of Eagle Court and released on her own recognizance.

The Wyoming County Sheriff’s Office arrested David A Calkins, 36, of South Wales, following a traffic stop on Rt. 78 in the Town of Sheldon on October 3, 2019.

Deputies on patrol observed a vehicle speeding above the posted 55 mph speed limit. A traffic stop was conducted and during the stop it was found that Calkins had 11 active suspensions on his license.

Calkins was arrested and issued citations for speed over 55, unlicensed operator and aggravated unlicensed operation 2nd.

Calkins is to answer the charges on October 14, 2019 at 6:30 p.m. in the Town of Sheldon court.

Dorian K. Thompson, 30, of Buffalo, was arrested following a traffic stop on Route 63 in the Town of Covington on September 30, 2019.

Thompson was stopped for a registration display infraction, and was allegedly found to be in possession of marijuana and a partially burned marijuana cigar.

Thompson failed field sobriety testing and was taken into custody for DWAI/ Drugs. Thompson’s vehicle was then towed from the scene, and he was taken to the Wyoming County Sheriff’s Office for an evaluation by a Drug Recognition Expert.

Thompson was found to be impaired by cannabis and unable to operate a vehicle safely. He is charged with DWAI/drugs, unlawful possession of marijuana, and improperly affixed registration sticker.

Thompson was processed then released to a family member, and is scheduled to answer the charges in the Town of Covington Court on October 28, 2019.

Amy R. Huffer, 31, of Eagle, was charged with operation with a suspended registration and failure to notify DMV of address change following a traffic stop on Route 39 on October 1, 2019.

Huffer was found to be operating a vehicle with suspended plates for an insurance lapse. She was released with appearance tickets and will answer the charges in the Town of Pike Court on October 22, 2019.

Rita M. Russo-Cammock, 55, of East Stroudsburg, PA, was arrested following a traffic stop on Route 20A in the Town of Warsaw on October 2, 2019.

Russo-Cammock was stopped for passing a vehicle in a no passing zone.

During the investigation, it was discovered that Russo-Cammock was not able to safely operate her motor vehicle in a safe manner as she was determined to be under the influence of depressants following a drug recognition evaluation.

Russo-Cammock was subsequently charged with felony DWAI/drugs as she had a previous conviction for DWAI/drugs within the preceding ten years.

Russo-Cammock is also charged with improper passing, passing on a hillcrest and criminal possession of a controlled substance 7th.

She was arraigned in the Town of Warsaw Court and jailed in lieu of $10,000.00 cash bail or $20,000.00 bond.

Russo-Cammock re-appear in the Town of Warsaw Court on October 7, 2019 for further proceedings.

Cindy A. Magaro, 58, of East Stroudsburg, PA, was arrested following a traffic stop on Route 20A in the Town of Warsaw on October 2, 2019.

Magaro was a passenger in a vehicle that was stopped for a vehicle and traffic violation. Through investigation, it was discovered that Magaro was in possession of two controlled substances. Magaro was subsequently arrested for two counts of criminal possession of a controlled substance 7th.

Magaro was arraigned in the Town of Warsaw Court and jailed in lieu of $1,000.00 cash bail or $2,500.00 bond.

Magaro re-appear in the Town of Warsaw Court on October 7, 2019 for further proceedings.

Daniel R. Chislom, 18, of Castile, was arrested following an investigation in to a domestic incident in the Village of Castile on October 3, 2019.

Chislom was observed by law enforcement breaking a smart phone that belonged to a family member and was subsequently charged with criminal mischief 3rd, class E felony.

Chislom was arraigned in the Town of Perry Court and remanded to the Wyoming County Jail on $250 bail. He appeared in the Village of Castile Court on October 7, 2019.

Lea M. Falcone, 35, of Pike, was arrested following execution of an arrest warrant on October 3, 2019.

Falcone was wanted for a violation of felony Probation and was located at a business in Letchworth State Park on October 3, 2019. She was taken into custody without incident and turned over to the Wyoming County Jail to await a Wyoming County Court appearance on October 4th.

The New York State Parks Police assisted with the arrest.

The NYS Police and NYS Parks Police assisted at the scene.

David M. Stowell, 49, of Perry, was arrested following a traffic stop on East Lake Road in the Town of Castile on October 4, 2019.

Stowell was stopped for having a suspended registration for no insurance in effect. Stowell was issued traffic tickets for operating without insurance and operating while registration suspended. He is scheduled to answer the charges in the Town of Castile Court on October 28, 2019.

Lakya N. Pinkney, 34, of Albany, was arrested following a traffic stop on Dunbar Road in the Town of Attica on October 6, 2019.

Pinkney was stopped for traffic infractions and was found to have a suspended driver’s license for failure to pay a fine.

Pinkney is charged with aggravated unlicensed operation 3rd, failure to keep right, and driver’s view obstructed.

Pinkney was released and is scheduled to answer the charges in the Town of Attica Court on October 21, 2019.

Ashley R. Washington, 28, of Rochester, was arrested following a traffic stop on State Route 98 in the Town of Attica October 6, 2019.

Washington was pulled over after failing to signal for a right hand turn.

Washington was then found to have four suspensions on two dates for failure to answer a summons. She is charged with aggravated unlicensed operation 3rd and unsafe turn without signal.

Washington was released from the scene after her vehicle was towed and she is scheduled to answer the charges in the Town of Attica Court on October 21, 2019.

Cody J. Lebel, 29, of Amherst, was arrested following a 911 call placed for an erratic driver on October 4, 2019.

At around 9:17p.m., deputies were advised to be on the lookout for a vehicle being operated on Route 20A that was driving all over the road and speeding.

Deputies were able to locate the vehicle in the Town of Warsaw where multiple vehicle and traffic violations were observed. The vehicle also appeared to have severe damage from striking an object.

Lebel was stopped, and following a roadside investigation involving field sobriety testing, was placed under arrest for DWAI Drugs.

Lebel was transported to the Wyoming County Sheriff’s Office where he underwent a drug influence evaluation and was found to be impaired by drugs and unable to operate a vehicle safely.

Deputies were able to locate the cause of the damage to the car, when Lebel’s front bumper and license plate were located on Route 20A in the Town of Sheldon. The vehicle had left the roadway striking a road sign and guard rail.

In the Town of Sheldon, Lebel is charged with leaving the scene of an accident, unsafe lane change, disobeying a traffic control device, and unlicensed operation.

In the Town of Warsaw, Lebel is charged with DWAI/drugs, reckless driving, and multiple traffic violations.

Lebel was turned over to a sober third party and will answer the charges in both Town Courts at a later date.
