BATAVIA POLICE REPORT/Harvester avenue man charged after domestic incident

Brian J. Miller, 38, of Harvester Ave., Batavia, is charged with harassment 2nd, criminal mischief and criminal obstruction of breathing following a domestic incident on January 12, 2020 on Harvester avenue.

Miller was transported to the Batavia Police Department Headquarters and processed. He was arraigned in City Court before Judge Rogers and released on recognizance.

Miller will re-appear in City Court on January 30, 2020 at 9:00a.m.

Kyle A. Mancuso, 27, of Ellicott St., Batavia, is charged with unlawful imprisonment, harassment 2nd and criminal mischief 4th after a domestic complaint on Ellicott street on January 19, 2020.

Mancuso was arraigned in City Court and released on recognizance.

He is due back in court on January 23, 2020.

Travis J. Schultz, 31, of Webber Ave., Oakfield, is charged with DWI and refusal to take a breath test after a hit an run accident on West Main street on January 19, 2020.

Police located the suspect vehicle and after conducting an investigation, Schultz was arrested and charged.

He was released with appearance tickets and will appear in City Court on February 5, 2020 at 9:00a.m.

Phillip P. Heale, 41, of Woodrow Rd., Batavia, is charged with criminal contempt 2nd after allegedly violating an order of protection barring him from contacting a protected party. The incident occurred on January 15, 2020.

Heale was issued an appearance ticket and will appear in City Court on February 4, 2020 at 1:00p.m.
