BATAVIA POLICE REPORT/Swan street man charged with burglary, criminal contempt

Jose A. Rivera, 34, of Swan St., Batavia, is charged with burglary 2nd and criminal contempt 2nd, after being found in the residence of a person who was protected from him by a stay away order of protection.

The incident occurred on July 27, 2020 at 5:59a.m.

Rivera was arraigned in City Court by Judge Rogers and held on $2,000 cash bail or $4,000 bond bail, or $8,000 partially secured bond.

He is scheduled to re-appear in court on August 27, 2020 at 11:00a.m.

Amy A. Potrzebowski, 34, of Burke Dr., Batavia, is charged with DWI, two previous convictions within 10 years, leaving the scene of a property damage accident and moving from a lane unsafely following an investigation into a motor vehicle accident on Richmond avenue on July 17, 2020 at 9:39p.m.

Potrzebowski was issued traffic tickets and is scheduled to appear in City Court on November 4, 2020.

Lyndsay T. Young, 37, of Ross St., Batavia, is charged with attempted assault 3rd following an investigation into a domestic incident at a residence in the City of Batavia on July 18, 2020 at 7:13p.m.

Young was released on an appearance ticket and will appear in City Court on October 10, 2020 at 1:00p.m.

Booker T. Ricks III, 48, of N. Lyons St., Batavia, is charged with endangering the welfare of a child following an incident where a child was allegedly unsupervised and hanging out of a window of the residence on July 18, 2020 at 7:47p.m.

Ricks was released with an appearance ticket and will appear in City Court on October 21, 2020 at 1:00p.m.

Jacob L. Hernandez, 25, of Lewis Pl. Batavia, was picked up on an arrest warrant out of City Court on July 28, 2020. Hernandez was charged with two counts of harassment 2nd/physical contact/following a person, after allegedly following someone and then striking another person during an incident on Lewis place on June 21, 2020 at 8:00p.m.

Hernandez was also arrested on a bench warrant out of City Court from November of 2019, where Hernandez allegedly failed to comply with court ordered programs.

He was transported to Police Headquarters, processed and released on appearance tickets.

Patricia A. Herzog, 53, of E. Main St., Batavia, is charged with trespass after allegedly entering a business at 577 East Main street where she had been previously told not to enter. The incident occurred on July 20, 2020 at 3:23p.m.

Herzog was issued an appearance ticket and will appear in City Court on October 20, 2020.
