WYOMING COUNTY SHERIFF’S REPORT/Pavilion man charged after cannabis found growing behind his residence

Brian L. Dutton, 62, of Pavilion, was arrested following a joint investigation between the United States Border Patrol and the Wyoming County Sheriff’s Office.

A United States Border Patrol Helicopter Pilot located cannabis plants growing inside a metal enclosure behind Dutton’s residence on August 7, 2020, and the pilot then led Wyoming County Sheriff’s deputies to the location of the cannabis plants.

The cannabis plants were seized and all growing materials were destroyed.

Dutton was arrested on August 12, 2020 for growing the plants.

Dutton was issued an appearance ticket for unlawfully growing cannabis and unlawful possession of marijuana 2nd.

Dutton is scheduled to answer the charges on August 31, 2020 in the Town of Covington Court.

John Cruz-Barnhardt, 34, of Nunda, NY, was arrested and charged with DWAI/drugs after driving on Route 19A, in the Town of Genesee Falls on August 6, 2020.

Cruz-Barnhardt was stopped for a traffic violation.

While speaking with the deputy, he displayed several signs of impairment. Cruz-Barnhardt submitted to standardized field sobriety testing and was placed under arrest.

Cruz-Barnhardt is charged with operating a motor vehicle while using a portable electronic device, DWAI/drugs, and DWAI/drugs combination. He was released with appearance tickets and is to appear in Genesee Falls Town Court later this month to answer the above charges.

Jason L. Darby, 48, of Warsaw, was arrested following a larceny investigation at the Warsaw Wal-Mart store on August 9, 2020.

Darby, who was on New York State Parole for robbery, was alleged to have stolen a pocket knife from the store. He fled the scene prior to apprehension.

Darby was later located at an address on North Maple Street in the Village of Warsaw. He was found in possession of the stolen knife and subsequently arrested.

Darby was processed at the Wyoming County Sheriff’s Office and issued an appearance ticket for petit larceny and criminal possession of stolen property 5th.

Darby is scheduled to answer the charges in the Town of Warsaw Court on August 24, 2020.
