On August 19, 2020 at approximately 2:58a.m., a Deputy from the Wyoming County Sheriff’s Office and an Officer from the Village of Warsaw Police Department attempted to conduct a traffic stop of a motorcycle on North Main Street in the Village of Warsaw after a violation of the NYS Vehicle and Traffic Law.
The operator of the motorcycle immediately accelerated upon the activation of the Officer’s emergency lights, and began traveling southbound on Main Street at speeds in excess of 110 MPH.
Officer’s continued to pursue the motorcycle, south of the Village of Warsaw on Route 19, at which point the operator made a westerly turn onto Miller Road. At this point in time, Officers lost sight of the motorcycle and continued to check the area.
Shortly thereafter, Officers located the motorcycle and the operator, Darryl Offhaus, 23, of Java, NY, who had been involved in an accident on Miller Road in the Town of Warsaw. Gainesville Ambulance was requested to the scene to evaluate Offhaus, who was then transported by Monroe Ambulance to Erie County Medical Center for non-life threatening injuries.
Deputies responded to ECMC, as Offhaus was suspected of being impaired by alcohol at the time of the accident. Offhaus was requested to submit to a chemical test to determine the alcohol content of his blood, which he refused. He was also found to have a revoked NYS driver’s license due to a prior arrest for DWI.
As a result of the incident, Offhaus is charged as follows:
DRIVING WHILE INTOXICATED (FELONY DUE TO PRIOR CONVICTION), AGGRAVATED UNLICENSED OPERATION 1ST DEGREE, UNLAWFUL FLEEING OF A POLICE OFFICER IN A MOTOR VEHICLE 3RD DEGREE, OPERATING OUT OF INTERLOCK RESTRICTIONS, RECKLESS DRIVING, REFUSAL TO SUBMIT TO A BREATH TEST, FAILED TO COMPLY WITH A LAWFUL ORDER, UNLICENSED OPERATOR, INSUFFICIENT TURN SIGNAL, FAILED TO KEEP RIGHT, SPEED IN ZONE (110/45), UNREGISTERED MOTOR VEHICLE, UNINSPECTED MOTOR VEHICLE, OPERATING WITHOUT INSURANCE, AND IMPROPER PLATES.
He was issued an appearance ticket and is scheduled to return to the Town of Warsaw Court at a later date.
Offhaus was additionally charged with violations of the NYS Vehicle and Traffic Law by the Warsaw Police Department stemming from the incident.
