BATAVIA POLICE REPORT/Rochester man charged with felony DWI after allegedly driving the wrong way on N. Spruce street

Glennder J. Velez, 24, of Moulson St. Rochester, NY, is charged with felony DWI, felony driving with a BAC of .08% or more, aggravated unlicensed operation 1st, driving in the wrong direction on a one way street and operating without an interlock device, following a traffic stop on North Spruce street on October 23, 2020 at 8:14p.m.

Velez was stopped by police after he was allegedly observed traveling the wrong way on North Spruce street.

Velez was processed and will appear in City Court on January 6, 2021 at 9:00a.m.

Rosemary R. Waters, 34, of East Main St., Batavia, is charged with DWAI/drugs combination and unregistered motor vehicle, after an investigation at a traffic stop on Dellinger avenue on August 17, 2020, where Waters was allegedly driving under the influence of drugs.

Waters was released on appearance tickets and will appear in City Court on January 20, 2021 at 9:00a.m.

Joel Morales Cruz, 46, of Swan St., Batavia, is charged with speeding(speeding in a zone), illegal signal(less than 100 feet), failure to notify of change of address, DWI, and driving with a BAC of .08% or more, 1st offense, after a traffic stop at 196 Oak street on October 25, 2020 at 4:38a.m.

Cruz completed standardized field sobriety tests , which resulted in his arrest.

He was processed and released on appearance tickets and will appear in City Court on January 26, 2021 at 1:00p.m.

Donald V. Notaro Jr., 22, of Tonawanda, NY, is charged with operating a motor vehicle while impaired by drugs, 1st offense, and inadequate headlights, after a traffic stop on July 3, 2020 at 11:45p.m..

Notaro was processed at the Batavia Police Department, and issued uniform traffic tickets. and released.

He will appear in City Court on January 26, 2021 at 9:00a.m.

Jose Garcia, 35, of S. Main St., Batavia, is charged with criminal mischief 4th following an investigation into an incident where he allegedly kicked and damaged a front door of a residence.

Garcia was issued an appearance ticket and released. He will appear in City Court on November 10, 2020.

Jamie L. Soto, 45, of W. Main St., Batavia, is charged with criminal contempt 1st, after an investigation where Soto allegedly violated a stay away order of protection, by having physical contact with the protected party on October 25, 2020.

Soto was arraigned in City Court by Judge Rogers and held without bail.

Russell J. Hamilton, 30, of Myrtle St., LeRoy, is charged with criminal contempt 2nd, after an investigation into a violation of an order of protection on October 21, 2020.

Hamilton allegedly sent the protected party a text message while at a residence in Batavia.

He was released on an appearance ticket and will appear in City Court on January 26, 2021.

On October 26, 2020, Hamilton was charged again with criminal contempt 2nd, after allegedly violating an order of protection by being present at the protected party’s home.

Russell was arraigned in City Court by Judge Rogers and bail was set at $2,000 cash, $4,000 bond and $8,000 partially secured.

Brandon C. Dodd, 33, of Highland Park, Batavia, is charged with petit larceny following a larceny that occurred at 390 West Main street, Tops Supermarket, on October 19, 2020.

Dodd allegedly stole items from Tops. He was released on an appearance ticket and will appear in City Court on January 12, 2021 at 1:00p.m.
