On October 15, 2020, at about 8:26pm, a deputy with the Wyoming County Sheriff’s Office was patrolling eastbound on Route 39, in the Town of Eagle, when he observed the vehicle in front of him tailgating another vehicle.

The vehicle in front of the patrol car then began to pass the lead vehicle in a no passing zone approaching a slight curve in the roadway, east of Lyonsburg Road.

The headlights from a westbound vehicle were observed and the passing vehicle cut back into the eastbound lane to avoid a collision, leading to the passing vehicle and lead vehicle to collide and turn sideways in the roadway. As both vehicles continued eastbound, the deputy pursued both vehicles and initiated a vehicle and traffic enforcement stop.

The driver of the passing vehicle was identified as a 17 year old male who was arrested and charged with reckless driving, unsafe pass on the left, driving left of pavement markings and following too closely.

The driver of the lead vehicle was identified as Kyle P. Baines, 31, of Arcade. While speaking with Baines, the deputy observed signs of possible impairment and asked Baines to perform standardized field sobriety tests, which he allegedly performed poorly.

Baines was arrested and transported to the Wyoming County Sheriff’s Office where he submitted to a Datamaster DMT breath test.

Baines was charged with DWI, driving with a .08%BAC or greater, open container and littering.

Both Baines and the 17 year old male were issued appearance tickets and are scheduled to appear in the Town of Eagle Court at a later date.
