Derek F. McQueen, 33, of Phelps Rd., Corfu, is charged with vehicular assault 2nd, DWAI/Combined influence of drugs, aggravated unlicensed operation 3rd, following too closely and unlicensed operator, after a two vehicle accident on Batavia Elba Townline road in Elba on September 15, 2020 at 1:04p.m.
Following an investigation of the accident, it was determined that McQueen was allegedly at fault. A license check found that his NYS driver’s license was revoked.
McQueen was suspected of being under the influence of drugs during the investigation. Standardized Field Sobriety tests were conducted and McQueen was arrested afterwards for DWAI/drugs.
After being transported to the Genesee County Jail, a drug influence evaluation was completed by City of Batavia Police Detective Wojtaszczyk, who concluded that McQueen was allegedly under the influence of multiple categories of drugs.
On January 4, 2021, McQueen was charged with vehicular assault 2nd, due to the injury sustained by an occupant of the other vehicle involved in the accident.
He was issued an appearance ticket and is scheduled to appear in the Town of Elba Court on January 27, 2021 at 5:00p.m.
