WYOMING COUNTY SHERIFF’S REPORT/ Varysburg man runs out of gas in stolen car, tells deputies he’s somebody else

On January 18, 2021 at approximately 4:08a.m., deputies from the Wyoming County Sheriff’s Office responded to Royce Road in the Town of Java for the report of a stranded motorist who was out of gas.

Upon arrival, deputies spoke with the male operator, who falsely identified himself with another individual’s New York State driver’s license.

Deputies were familiar with the individual pictured on the ID, which was clearly not the vehicle operator. Shortly thereafter, deputies discovered that the vehicle was stolen from the City of Batavia.

The male driver was taken in to custody and was eventually identified as Michael A. Sweet, 34, of Varysburg, NY . Sweet allegedly possessed a suspended New York State license, and had several active warrants for his arrest.

He is charged with criminal possession of stolen property 4t (vehicle), criminal impersonation 2nd, and aggravated unlicensed operation 3rd. Sweet is scheduled to appear in the Town of Java Court at a later date to answer the charges,

Tai R. Harvey, 31, of Rochester, was arrested following a traffic stop on Route 39 in the Town of Perry on January 28, 2021.

Harvey was stopped for erratic operation, and during the stop, Harvey was found to have ten active suspensions on her non-driver identification card.

Harvey’s vehicle was towed from the scene, and she was taken to the Wyoming County Sheriff’s Office for processing.

Harvey is charged with aggravated unlicensed operation 2nd, unlicensed operator, failed to keep right, and driver’s view obstructed. Harvey was issued an appearance ticket to answer the charges in the Town of Perry Court on February 24, 2021.

On January 9, 2021, at about 7:37p.m., deputies responded to the area of Lyonsburg Road and Telegraph Road, in the Town of Eagle, for the report of a car off the roadway into a culvert. The complainant also advised the driver of the vehicle was possibly under the influence.

Deputies arrived on scene and met with the driver of the vehicle, Shane A. Boller, 36, of Arcade. While speaking with Boller, the deputy observed several indicators of possible impairment and initiated a roadside DWI investigation, which included standardized field sobriety testing.

Following field sobriety testing, Boller was placed under arrest and transported to the Wyoming County Sheriff’s Office where he submitted to a certified breath test. Boller also submitted to a drug influence evaluation conducted by a NYS certified Drug Recognition Expert. Following the evaluation, it was the DRE’s expert opinion that Boller was under the influence of a drug and alcohol combined and could not operate a motor vehicle safely.

Boller is charged with DWI, driving with a .08%BAC or greater, DWAI/ drugs, DWAI/ drugs combo and failure to keep right.

Boller was released on appearance tickets following processing and is scheduled to appear in the Eagle Town Court at a later date.
