WYOMING COUNTY SHERIFF’S REPORT/Accident in Middlebury leads to charges for driver

On April 22, 2021, at about 6:39p.m., deputies responded to the area of West Middlebury Road and Kingsley Road, in the Town of Middlebury, for the report of a car in the ditch and it was occupied.

Deputies arrived on scene and observed the vehicle to be in the north side of the ditch, facing east, after crossing the westbound lane. The driver of the vehicle was identified as Kelly A. Everts, 38, of Perry. While investigating the accident, the deputy believed Everts was impaired by alcohol and conducted a roadside DWI investigation.

Following standardized field sobriety testing, Everts was placed under arrest for DWI and transported to the Wyoming County Sheriff’s Office where a certified breath sample was collected.

Everts was ultimately charged with DWI, driving with a .08% BAC or greater and failure to keep right.

Everts was released on an appearance ticket and is scheduled to appear in the Town of Middlebury Court at a later date.

Deputies responded to Church Road in the Town of Bennington, for the report of a one car rollover accident on April 26, 2021.

Upon arrival, Deputies spoke with the driver and sole occupant of the vehicle, Nathan P. Helak, 30, of Attica.

Following an investigation, which included field sobriety testing, Helak was arrested for DWI.

Helak was transported to the Wyoming County Sheriff’s Office where he supplied a breath sample that was over the legal limit of .08%. Helak is charged with moving from a lane unsafely, felony driving while intoxicated, felony driving with a BAC .08% or more and felony aggravated driving while intoxicated with a B.A.C .18% or more.

Helak is charged with a felony as he had a previous conviction for DWI within the preceding ten years.

While processing Helak at the Wyoming County Sheriff’s Office, Helak was also charged with criminal mischief in the fourth degree after he intentionally caused damage to an office chair.

Helak is to appear in the Bennington Town Court on May 17, 2021 for initial arraignment on the DWI charges. He will also appear in the Village of Warsaw Court on May 17, 2021 for initial arraignment on the criminal mischief charge. Deputies were assisted at the accident scene by the Village of Attica Police Department and Bennington Fire Department.

Drivers in separate vehicles were both arrested following a traffic stop on Route 20A at Silver Lake Road in the Town of Perry on April 22, 2021.

Julius C. Young, Jr., 56, of Buffalo, was stopped for equipment infractions while driving a PA plated 2003 BWM, and the vehicle was found to have switched plates, no insurance, and Young was also found to have an expired and suspended NYS driver’s license with four active suspensions.

During the traffic stop, a second vehicle, which had been traveling with Young, pulled up to the scene. The driver of that vehicle, Telly F. Willis, 44 of Buffalo, was found to have a non-driver identification card with eight total active suspensions.

Both operators were taken into custody, and both vehicles were towed from the scene. Young and Willis were transported to the Wyoming County Sheriff’s Office where charges were filed as follows:

YOUNG: Aggravated unlicensed operation in the third degree, unlicensed operation, switched plates, unregistered motor vehicle, uninspected motor vehicle, operating without insurance, and side windows non-transparent.

WILLIS: Aggravated unlicensed operation in the second degree, aggravated unlicensed operation in the third degree, unlicensed operation, and inadequate stop lamps.

Both Young and Willis were issued appearance tickets to answer the charges in the Town of Perry Court on May 5, 2021.

Lateef A. Sobola, 21, of Bronx, NY, was arrested following a traffic stop on Route 20A at Suckerbrook Road in the Town of Perry on April 22, 2021.

Sobola was stopped for an entirely tinted front windshield, and Sobola was then found to have two active suspensions on his NYS Driver’s license for failure to answer a summons.

Every window on Sobola’s vehicle was completely tinted, and a tint meter showed the windows were allowing 1% of light to transmit when the minimum allowed by law is 70%. Sobola’s vehicle was towed from the scene, and Sobola was issued appearance tickets for aggravated unlicensed operation in the third degree, non-transparent front windshield, and non-transparent side windows.

Sobola is scheduled to answer the charges on May 5, 2021 in the Town of Perry Court.

On April 21, 2021, at about 6:30p.m., deputies responded to the area of Route 20A and the Erie County line for an erratic driver complaint.

Dispatch provided the license plate given by the caller and deputies were familiar with the registered owner of the vehicle. Deputies responded to the residence to check the welfare of the owner, and the vehicle was observed in the driveway. The owner advised he was not the driver of the vehicle and following an investigation, Mary K. Augello, 31, of Buffalo was discovered to be the driver of the vehicle at the time of the complaint. Deputies ran a license check on Augello, which showed she had a revoked license with 6 total suspensions/revocations.

Augello was arrested and charged with aggravated unlicensed operation 2nd degree, aggravated unlicensed operation 3rd degree and unlicensed operator. Augello was released with an appearance ticket and is scheduled to appear in the Town of Sheldon Court at a later date.

Jeremy W. Crafts, 22, of Blasdell, NY, was arrested following a traffic stop on Route 20A at Coe Road in the Town of Perry on April 25, 2021.

Crafts was stopped for operating a vehicle with a suspended registration and for no insurance in effect.

During the traffic stop, Crafts was found to be operating with a suspended driver’s license, and glass vials were recovered from within Crafts’ vehicle containing scheduled II controlled substance anabolic steroids, Drostanolone and Testosterone.

Crafts’ vehicle was towed from the scene, and he was taken to the Wyoming County Sheriff’s Office for processing.

Crafts is charged with two counts of criminal possession of a controlled substance in the seventh degree, aggravated unlicensed operation in the third degree, operating a suspended registration, operating without insurance, and uninspected motor vehicle.

Crafts was released with an appearance ticket, and he is scheduled to answer the charges in the Town of Perry Court on May 12, 2021.
