Arrests

Assault 2nd; Criminal Possession of a Weapon 3rd, 5:11 PM, Wednesday, May 26, 2021, Cedar St. – On 5/27/2021, Zachari MORGAN, M/25, was arrested on the above charges. It’s alleged that MORGAN threw a rock at another person, striking them in the head during an altercation at DeWitt Park. He was arraigned in Batavia City Court by Judge BURNS and released under the supervision of Genesee Justice.   

Dog Running at Large, 8:05 PM, Tuesday, May 18, 2021, E Main St. – On 5/27/2021, Paul SCHWARTZMEYER, M/42, was arrested on the above charge. It’s alleged that SCHARTZMEYER allowed his dog to run at large in the parking lot of an apartment complex, where the dog attacked another dog. SCHWARTZMEYER was issued an appearance ticket and is scheduled to appear in Batavia City Court on 6/15/2021.  

Assault 3rd; Endangering the Welfare of a Child, 5:11 PM, Wednesday, May 26, 2021, Cedar St. – On 5/27/2021, Zachari MORGAN, M/25, was arrested on the above charges. It’s alleged that he slapped and threw another person on the ground causing injury during a domestic incident at DeWitt Park on 5/26/2021. He was arraigned in Batavia City Court by Judge BURNS and released on his own recognizance. He is due back in court on 7/8/2021.  

Unlawful Imprisonment 2nd; Harassment 2nd , 1:15 PM, Tuesday, May 25, 2021, Pearl St. – On 5/25/2021, Modesto DOMINGO-CARDENAS, M/27, was arrested on the above charges. He was arrested after a domestic incident where he allegedly slapped another person and then attempted to prevent that person from leaving the residence. He was arraigned in Batavia City Court by Judge ROGERS and released on his own recognizance. He is due back in court on 7/1/2021.  

Menacing 3rd, 5:04 PM, Wednesday, May 26, 2021, McKinley Ave. – On 5/26/2021, Officer POST arrested Thomas MARTIN, M/80, for menacing in the third degree following a dispute where MARTIN allegedly threatened another male. MARTIN was issued an appearance ticket with a return court date of 6/01/2021 at 1:00PM to the Batavia City Court.  

Petit Larceny; Conspiracy 6th , 3:38 PM, Wednesday, April 28, 2021, Ellicott  St. – On 5/24/2021, Lynn HOMER, F/48, and Joseph FREEMAN, M/38, were arrested on arrest warrants from Batavia City Court. It’s alleged that HOMER and FREEMAN, together, stole merchandise from a local business. They were arraigned by Judge ROGERS and released under the supervision of Genesee Justice. FREEMAN is due back in court on June 23rd, 2021 at 2:00PM. HOMER is due back in court on June 24th, 2021 at 2:30PM.  

Petit Larceny; Conspiracy 6th , 6:55 PM, Tuesday, May 4, 2021, Ellicott  St. – On 5/24/2021, Lynn HOMER, F/48, and Joseph FREEMAN, M/38, were arrested on arrest warrants from Batavia City Court. It’s alleged that HOMER and FREEMAN, together, stole merchandise from a local business. They were arraigned by Judge ROGERS and released under the supervision of Genesee Justice. FREEMAN is due back in court on June 23rd, 2021 at 2:00PM. HOMER is due back in court on June 24th, 2021 at 2:30PM.  

Criminal Obstruction of Breathing; Harassment 2nd; Criminal Mischief, 9:00 PM, Thursday, May 20, 2021, Hutchins St. – On 5/21/2021, Tevin BLOOM, M/27, was arrested after an investigation into a domestic incident where BLOOM was alleged to have been involved in a physical altercation. BLOOM also allegedly damaged property inside of the victim’s apartment. BLOOM was arraigned in Batavia City Court by Judge ROGERS and released to appear on 6/23/2021 at 2:00PM.  

Disorderly Conduct, 10:51 PM, Thursday, May 20, 2021, Washington Ave. – On 5/20/2021, Officer POST arrested Dustin WILCOX, M/36, for disorderly conduct after WILCOX was allegedly involved in a fight on Washington Avenue. WILCOX was issued an appearance ticket with a return court date of 06/01/2021 at 1:00PM to the Batavia City Court.  

Disorderly Conduct, 10:55 PM, Thursday, May 20, 2021, Washington Ave. – Lawrence BOONE, M/30, was arrested on the above charge outside a Batavia residence after he was located by Batavia Police, physically fighting another male in the street. BOONE was subsequently arrested and issued an appearance ticket. BOONE is scheduled to appear in Batavia City Court on 05/25/2021 at 1:00PM.  

Harassment 2nd; Endangering the Welfare of a Child, 2:57 PM, Friday, May 14, 2021, Oak  St. – On 5/21/2021, Rachel BAEHR, F/34, was arrested after an investigation after she alleged to have been involved in a physical altercation during a domestic incident. BAEHR was issued an appearance ticket to appear in Batavia City Court.  

Fail to Appear after Appearance Ticket Served; Aggravated Unlicensed Operation (AUO) 3rd; Operating a Motor Vehicle with a Suspended Registration, 3:38 PM, Sunday, August 9, 2020, Willow  St. – Kyle SHEA, M/26, was arrested on 5/20/2021 at 2:39PM on an Arrest Warrant. It is alleged that SHEA was driving a motor vehicle with a suspended license and suspended registration. SHEA failed to appear for his scheduled court dates, resulting in a warrant for his arrest to be issued. SHEA reported to BPD and turned himself in. SHEA was arraigned in BCC by Judge BURNS at 3:35 PM. The matter was resolved completely by a plea. No future court proceedings are scheduled. 

Burglary 2nd; Criminal Contempt 2nd; Criminal Contempt 1st; Criminal Mischief 4th; Criminal Mischief 3rd; Endangering the Welfare of a Child, 9:14 PM, Tuesday, May 4, 2021, Walnut St. – Kevin THOMAS, M/32, turned himself in to Genesee County Jail on 05/18/2021, on numerous active warrants he had. THOMAS was arraigned at 2:30PM in Batavia City Court by Judge ROGERS on an arrest warrant. THOMAS was arraigned on charges of burglary in the second degree, criminal contempt in the second degree, criminal mischief in the fourth degree, criminal mischief in the third degree, endangering the welfare of a child, and criminal contempt in the first degree following a domestic incident that occurred on 05/04/2021. THOMAS’ bail was set for $1.00 and is due back in Batavia City Court on 6/22/2021 at 3:00 PM.
