WYOMING COUNTY SHERIFF’S REPORT/Warsaw man charged under Leandra’s Law after fleeing from police on an ATV with two children

Jesse E. Burns, 28, of Warsaw, was arrested after fleeing from police on an ATV on Christ Road in the Town of Warsaw on May 31, 2021.

Deputies observed a red Suzuki ATV driving on the roadway on Christ Road, occupied by three people who all were not wearing helmets. Upon activating the emergency lights on the marked patrol car, the ATV fled northbound on Christ Road at a high rate of speed. No pursuit was engaged by deputies, and deputies observed as the vehicle drove off into a wooded area. Deputies entered the wooded area on foot and located the ATV abandoned.

Following further investigation, Burns was determined to have been the driver of the ATV, and the passengers were determined to have been 12 and 14 year old girls. Burns was located at a residence on Christ Road and taken into custody. He was taken to the Wyoming County Sheriff’s Office for further interview and processing, and was found to have been allegedly drinking, and after performing poorly on standardized field sobriety testing, Burns was additionally arrested for DWI, reckless endangerment 2nd degree (2 Counts), endangering the welfare of a child (2 counts), aggravated DWI – child in vehicle, Leandra’s Law, class E felonies, (2 counts), DWI, driving with .08% BAC or higher, passenger under 16 no helmet ATV (2 Counts), no helmet ATV, unregistered ATV, uninsured operation ATV, speed not reasonable and prudent ATV, unlawful operation on public highways ATV, inadequate muffler ATV, and failed to comply with lawful order ATV

Burns was processed at the Wyoming County Sheriff’s Office and then released with an appearance ticket in compliance with NYS Bail Reform Laws. Burns was turned over to a sober third party and scheduled to answer the charges on June 14, 2021 in the Town of Warsaw Court.

A Pennsylvania man was arrested two times in the same day on two separate and unrelated traffic stops. On May 30, 2021 at 6:14 PM, Joshua L. Fryer, 33, of Hazleton , PA, was stopped by a Wyoming County Deputy Sheriff Sergeant while driving his 2011 Mercedes-Benz for a window tint violation on Route 20A in the Town of Perry.

Fryer was found to be driving with three active suspensions in New York State on his PA driver’s license. Fryer’s vehicle was towed from the scene, and Fryer was cited for two window tint violations and one misdemeanor, aggravated unlicensed operation 3rd degree. Fryer was provided with a transport to a local hotel and released on an appearance ticket to answer the charges on June 9, 2021 in the Town of Perry Court.

On the same date, at 8:17 PM, another Wyoming County Deputy Sheriff Sergeant attempted to stop a 2011 Mercedes-Benz for a window tint violation on Route 20A in the Town of Perry. Before the patrol vehicle activated the emergency lights, the 2011 Mercedes-Benz turned off southbound onto Route 246 at a high rate of speed.

The suspect vehicle made an abrupt left turn into the Perry Center Fire Hall parking lot in an attempt to hide from the police vehicle, and in doing so, the vehicle drove past three young children playing outside in an adjacent parking lot. The Mercedes-Benz was quickly located behind the fire hall parked up against the building, and skid marks were observed throughout the parking lot from the Mercedes-Benz operating at high speeds.

Fryer was found to be the operator of the vehicle, and was taken into custody for the second time. Fryer’s vehicle was again towed from the scene, and Fryer was charged with three counts of reckless endangerment 2nd degree, aggravated unlicensed operation 3rd degree, reckless driving, unsafe turn without signal, failed to keep right, and four total tickets for window tint.

Fryer was processed at the Wyoming County Sheriff’s Office, and in conformance with the NYS bails reform laws, Fryer was released on an appearance ticket to answer the charges in the Town of Perry Court on June 9, 2021.

Destinee A. Loyd, 33, of Orchard Park, NY, was arrested following a traffic stop on Pee Dee Road near Youngers Road in the Town of Java on May 29, 2021. Loyd was pulled over by deputies after being observed driving with an expired vehicle inspection certificate.

During the stop, Loyd was found to allegedly be in possession of concentrated cannabis. Loyd was also found to have two children in her vehicle, ages 7 and 8. She performed poorly on standardized field sobriety testing and was taken into custody for DWAI/drugs.

The children and vehicle were released to a sober third party at the scene, and Loyd was taken to the Wyoming County Sheriff’s Office for a drug influence evaluation by a Drug Recognition Expert. Following the evaluation, Loyd was determined to be impaired by the combined influence of multiple drugs and unable to operate a vehicle safely.

Loyd is charged with aggravated DWI – Child in Vehicle (2 Counts – Class E Felony), DWAI/drugs, driving while ability impaired by the combined influence of drugs, and uninspected motor vehicle

Loyd was issued an appearance ticket and scheduled to answer the charges in the Town of Java Court on June 16, 2021. She was processed then released to a sober third party.

Deputies from the Wyoming County Sheriff’s Office responded to an address in the Town of Perry for a possible domestic violence incident. After investigation it was found that Adam Valentine, 42, had broken a window to a vehicle that does not belong to him. Valentine was placed under arrest for criminal mischief. While the deputy attempted to place him in handcuffs he physical resisted arrest.

Valentine is charged with criminal mischief 3rd and resisting arrest. He was arraigned at the Town of Middlebury Court in front of Judge Strathearn with a public defender present. Valentine was held at the Wyoming County Jail with no bail set. He is to appear at Perry Town Court in June.

Following a traffic stop on Route 98 in the Town of Java on May 30, 2021, Brandon S Francis, 26, of Jamaica, New York was arrested for aggravated unlicensed operation 3rd degree, and speed exceeding 55 MPH.

Francis had one (1) suspension for failure to answer a summons. He was released with an appearance ticket and is to appear in Java Town Court at a later date to answer to the charge.

On May 26, 2021 at approximately 9:09a.m., a Deputy from the Wyoming County Sheriff’s Office conducted a traffic stop on Route 63 in the Town of Covington, after observing a violation of the New York State vehicle and traffic law. The operator identified herself as Rachael Nicholls, 23, of Geneseo, and during the traffic stop, the Deputy observed signs of alcohol impairment.

Nicholls did submit to field sobriety testing, which she performed poorly and exhibited signs indicative of alcohol impairment. Nicholls was subsequently arrested for DWI and transported to the Wyoming County Sheriff’s Office, where she agreed to submit to a breath test. She was also charged with speed over 55mph, driving with .08 of 1% or greater of alcohol in blood, and DWI. Nicholls was issued an appearance ticket and is scheduled to return to the Town of Covington Court at a later date.

On May 27, 2021, at around 2:25pm, a deputy with the Wyoming County Sheriff’s Office was operating stationary patrol on Route 246, in the Town of Covington, when a four door sedan was observed traveling southbound following a pickup truck towing a camper too closely. The deputy estimated there was approximately 10 feet between the sedan and the camper, therefore not leaving sufficient distance for braking and creating a safety hazard. The deputy pursued the vehicle southbound and initiated a vehicle and traffic enforcement stop on Route 246, near LaGrange Road.

The driver of the vehicle was identified as Jasmine S. Morales ,23, of Rochester, NY, and following a roadside interview, the deputy believed Morales was under the influence and started a roadside DWI investigation which included standardized field sobriety testing.

Following field sobriety testing, Morales was placed under arrest for DWAI/drugs and transported to the Wyoming County Sheriff’s Office where she submitted to a drug influence evaluation conducted by a NYS Certified Drug Recognition Expert. Following the drug influence evaluation, it was the DRE’s expert opinion that Morales was under the influence of drugs and could not operate a motor vehicle safely on a public highway.

Morales was ultimately charged with DWAI/drugs, following too closely, uninspected motor vehicle and consuming cannabis inside a motor vehicle. Morales was processed and released on an appearance ticket and is scheduled to appear in the Town of Covington Court at a later date.

Heba S. Mahmoud, 28, of Buffalo, NY, was arrested following a traffic stop on Route 20A in the Town of Warsaw on May 29, 2021. Mahmoud was stopped for an equipment infraction when she was found to be driving with three active suspensions on her Connecticut ID card.

Mahmoud was issued traffic tickets for aggravated unlicensed operation 2nd degree, unlicensed operation, and side windows non-transparent.

Mahmoud was issued an appearance ticket to answer the charges in the Town of Warsaw Court on June 14, 2021. Mahmoud and her vehicle were released to a valid driver.
