WYOMING COUNTY SHERIFF’S REPORT/Cowlesville man arrested twice for DWI within 12 hours, resisted arrest, resulting in a struggle with police

Marc J. Wydro, 35, of Cowlesville, NY, was arrested for DWI two times within 12 hours.

The first arrest occurred after a complaint at 11:48p.m. on June 18, 2021, on Route 354 in the Town of Bennington. Deputies responded to call for a male slumped over at the wheel of a running 2017 Cadillac in a parking lot.

Wyoming County Sheriff’s Deputies responded and located Marc J. Wydro alone in the running vehicle, in the driver seat, slumped over and unconscious. Wydro was awakened by a first responding deputy, and refused to cooperate with field sobriety testing.

The deputy then attempted to take Wydro into custody for DWI at which time he resisted arrest and led to a ground struggle. Wydro was eventually taken into custody by the deputy, and then refused to submit to a breath chemical test.

Wydro was transported to the Wyoming County Sheriff’s Office where he was charged with DWI, resisting arrest, and refusal to take a breath test. Wydro was arraigned in Warsaw Town Court where his driver’s license was suspended pending a chemical test refusal hearing. He was released on his own recognizance in compliance with NYS Bail Reform, and was released to a sober third party.

On June 19, 2021 at 11:22a.m, a Wyoming County Sheriff’s Sergeant was patrolling on Route 354 and observed Wydro operating his 2017 Cadillac westbound on Route 354. A traffic stop was conducted due to Wydro having just had his license suspended several hours prior.

During the traffic stop, Wydro was requested to perform field sobriety testing. Wydro was unable to perform the field sobriety tests at which time he was taken into custody again for DWI. Wydro’s vehicle was towed to the Wyoming County Impound to be held, and he was taken to the Wyoming County Sheriff’s Office. Wydro submitted to a breath chemical test for this arrest, and registered a .28% BAC.

Wydro was charged with aggravated unlicensed operation 1st degree, class E felony, aggravated DWI – .18% BAC or higher, DWI, and driving with .08% BAC or higher.

He was released on an appearance ticket in compliance with NYS Bail Reform and was released to a sober third party. Wydro is scheduled to answer the second DWI charges in the Town of Bennington Court on June 28, 2021.

A Cohocton, NY resident was arrested following a traffic stop on Route 63 in the Town of Covington on June 14, 2021.

Dillon R. Brandt, 28, was the operator and only occupant of a 2011 Chevrolet Cruze, which was stopped for speeding and for cutting off a tractor trailer. During the traffic stop, Brandt allegedly exhibited signs of impairment, and was taken into custody after performing poorly on roadside field sobriety testing.

A subsequent search of Brandt’s vehicle was conducted, and metal knuckles were recovered from a hidden location between the driver seat and armrest. Multiple pieces of drug paraphernalia were also located inside the vehicle.

Brandt was taken to the Wyoming County Sheriff’s Office where he was evaluated by a Drug Recognition Expert. Brandt was determined to be impaired by three different drug categories and unable to operate a vehicle safely.

He is charged with criminal possession of a weapon 3rd degree, a class D felony, driving while ability impaired by drugs, driving while ability impaired by the combined influence of drugs, reckless driving, consumption of cannabis in a motor vehicle, speed over 55MPH, improperly affixed registration sticker, unauthorized stickers, and driver’s view obstructed.

Brandt was arraigned virtually in front of the Warsaw Town Court, and following arraignment Brandt was released on his own recognizance as required by NYS Bail Reform. Brandt is scheduled to appear on June 25, 2021 in Wyoming County Court.

Justin C. Cole, 35, of Wales Center, NY, was arrested following a complaint of a subject sleeping in a vehicle that was still running and parked partially in the driving lane on Folsomdale road in Bennington. Deputies arrived and found the subject to be overdosing and Narcan was administered and successful.

Cole performed poorly on field sobriety testing and was found to have a positive presence of alcohol on his breath.

Cole was arrested and transported to the Wyoming County Sheriff’s Office for processing.

He is charged with DWI, driving with .08% BAC or higher and parked on pavement.

Cole was issued an appearance ticket and is scheduled to answer the charges in the Town of Bennington Court on June 28, 2021. Cowlesville Ambulance and DMR Towing assisted at the scene.

On June 18, 2021 at approximately 9:07a.m., a Deputy from the Wyoming County Sheriff’s Office conducted a traffic stop on Route 63 in the Town of Covington, after observing a violation of the NYS Vehicle and Traffic Law.

The operator of the vehicle identified himself as Andrew Bennett, 30, of Canandaigua.

Bennett was found to have a suspended non-driver ID only, with a total of two active suspensions. He was arrested and charged with aggravated unlicensed operation 3rd, unlicensed operator and uninspected motor vehicle. He was issued an appearance ticket and is scheduled to return to the Town of Covington court at a later date.
