Arrests

Bench Warrant, 1:00 PM, Monday, April 19, 2021, W. Main St. – On 6/22/2021, Marcella GREENE, F/36, was arrested on a bench warrant for failure to appear. GREENE was processed at the Batavia Police Department, arraigned before Judge ROGERS in Batavia City Court, and released, to appear in Batavia City Court on 8/5/2021, at 1:30PM.   

Arrest Warrant, 1:00 PM, Tuesday, May 4, 2021, W. Main St. – On 6/22/2021, Marcella GREENE, F/36, was arrested on an Arrest Warrant out of Batavia City Court after she failed to appear after receiving an appearance ticket previously. GREENE was processed at the Batavia Police Department, arraigned before Judge ROGERS in Batavia City Court, and released to appear on 8/5/2021 at 1:30 PM.  

Criminal Mischief; Criminal Trespass, 5:40 PM, Friday, February 27, 2020, Harvester Ave. – Jamie DUTTON, M/28, was arrested for the above listed charges. DUTTON allegedly entered a residence unlawfully by damaging windows at the property. DUTTON was issued an appearance ticket directing him to appear before Batavia City Court on 7/6/2021 at 1:00PM.  

Driving While intoxicated; Driving While Intoxicated – BAC >.08% BAC; Inadequate headlights, 2:28 AM, Sunday, June 20, 2021, Jefferson Ave. – On the above date and time Bianca TYSON, F/30, was arrested on the above charges following a traffic stop which was conducted on Jefferson Ave., where TYSON was allegedly found to be operating her vehicle while intoxicated. TYSON was issued an appearance ticket and is scheduled to appear in Batavia City Court on 7/20/2021 at 1:00PM.  

Criminal Mischief; Resisting Arrest, 10:21 PM, Friday, June 18, 2021, Holland Ave. – On 6/18/2021, Officer POST arrested Jaylinn O’NEIL, F/31, for criminal mischief in the fourth degree and resisting arrest, following a disturbance on Holland Ave. O’NEIL was issued an appearance ticket with a return court date of 6/29/2021, at 1:00 PM at Batavia City Court.  

Arrest Warrant, 10:45 AM, Monday, June 21, 2021, W. Main St. – The defendant, Nicole CASEY, F/33, turned herself into at the Batavia Police Department on an Arrest Warrant after failing to appear after an Appearance ticket was issued. The original charge stems from a shoplifting incident which occurred at a local business in February of 2018. The defendant was arraigned in front of Judge ROGERS and released. She was directed to appear in City Court on July 21, 2021.  

Aggravated DWI; DWI; Failure to Keep Right, 11:06 PM, Saturday, June 19, 2021, Ellicott St. – On 6/19/2021, Mitchell BATES, M/29, was arrested on the charges of DWI, Aggravated DWI – BAC above 0.18%, and failure to keep right. Charges stem from a motor vehicle accident in which BATES, allegedly, drove into oncoming traffic and struck another vehicle head on. BATES was processed at the Batavia Police Department and released on Uniform Traffic Tickets returnable to Batavia City Court on 9/21/2021 at 1:00PM.  

Arrest Warrant, 1:00 PM, Thursday, May 13, 2021, W. Main St. – On 6/15/2021, Tim KAUFFMAN, M/52, was arrested on an arrest warrant out of Batavia City Court. The warrant was issued after KAUFFMAN failed to appear in Batavia City Court on a Uniform Traffic Ticket. KAUFFMAN was processed, arraigned before Judge BURNS in Batavia City Court, and released on recognizance and is to appear in Batavia City Court at a later date.  

Petit Larceny, 4:36 AM, Thursday, June 17, 2021, East Ave. – On 6/17/2021, at approximately 4:55AM, Mitchell MERRILL, M/35, was arrested after an investigation where MERRILL was alleged to have been inside of a vehicle and took property that did not belong to him without the permission of the owner. MERRILL was released and issued an appearance ticket.  

Resisting Arrest; Obstruction of Governmental Administration; Speed in Zone; Aggravated Unlicensed Operation 3rd; Suspended Registration, 3:37 PM, Sunday, June 13, 2021, Alexander Rd. – On 6/13/2021, Kaleb BOBZIEN, M/23, was arrested on charges of obstruction of governmental administration, and resisting arrest. BOBZIEN failed to comply with Batavia Police Officers commands to exit his vehicle after being advised that he was under arrest on a warrant out of the Warsaw Police Department. BOBZIEN was processed, issued an appearance ticket returnable to Batavia City Court on 6/22/2021 at 1:00PM, issued Uniform Traffic Tickets and turned over to the Warsaw Police Department on the outstanding warrant.  

Criminal Mischief 3rd Degree, 10:00 PM, Saturday, April 24, 2021, N. Spruce St. – Thomas TACITO, M/61, was arrested following an investigation into a neighbor dispute where the victim had all four tires slashed and several windows smashed out on their vehicle. TACITO was charged with Criminal mischief in the 3rd degree and is accused of causing more than $250.00 worth of damage to the vehicle. TACITO was released on an appearance ticket ordering him to appear in Batavia City Court on 7/6/2021 at 1:00PM.

Harassment 2nd Degree; Obstructing Governmental Administration, 1:33 PM, Tuesday, June 15, 2021, N. Spruce St. – Jazmin PELLOT, F/38, was arrested on 6/15/2021 at 1:33PM for harassment in the second degree and obstruction of governmental administration following a domestic incident. It is alleged that PELLOT struck her victim in the face with a closed fist. It is also alleged that PELLOT interfered with officers and failed to comply with directives when the domestic incident was being investigated. PELLOT was arraigned by Judge ROGERS in Batavia City Court on 6/15/2021 at 3:45PM. PELLOT was released on her own recognizance and is due back in Batavia City Court on 7/22/2021 at 3:30 PM with Judge BURNS.

Criminal Contempt 2nd Degree, 1:30 PM, Thursday, June 17, 2021, N. Spruce St. – Thomas TACITO, M/61, was arrested on the above date and time on the aforementioned charge after he violated an order of protection by allegedly going to the protected party’s residence and knocking on their door. TACITO was issued an appearance ticket and is scheduled to appear in Batavia City Court at a later date.  

Criminal Possession of a Controlled Substance 7th Degree; DWI; Aggravated DWI; Fail to Keep Right, 6:10 PM, Thursday, February 25, 2021, E. Main St. – On 6/18/2021, Trevor M. RICH, M/40 was arrested on the above charges. The arrest comes as the result of an investigation into a motor vehicle accident that occurred on 2/25/2021, on E. Main St. RICH was allegedly found to have been drinking under the influence of alcohol. He also was allegedly found in possession of cocaine. RICH was issued appearance tickets and is scheduled to appear in Batavia City Court on 6/29/2021.
