Rape 1st Degree w/ Forcible Compulsion, 9:30 PM, Thursday, December 24, 2009, Jackson St. – Editrudis ZAVALA-PALACIO, M/52, was arrested following an investigation into a reported forcible rape from 2009 that occurred at an apartment above 15 Jackson St. ZAVALA-PALACIO was arraigned and held on $200,000 A/$400,000 B/ $400,000 C.  

Reckless Endangerment 2nd Degree, 1:00 AM, Sunday, May 30, 2021, East Ave. – Marquele TOMLIN, M/30, was arrested for reckless endangerment in the 2nd degree following a lengthy investigation into the report of an armed robbery where TOMLIN had been shot.

The investigation started on May 30th, 2021 around 2:45 AM when members of the Batavia Police Department were dispatched to UMMC for the report of a victim with a gunshot wound to the hand.

TOMLIN stated that he had been shot during a robbery earlier in the night while walking on East Avenue, somewhere between Vine Street and Elm Street.

Officers, Detectives, and a K-9 scoured the area, but were unable to locate any evidence of a crime scene. Several other areas of interest through the city were also checked with negative results. Detective IVISON watched hours of security footage and interviewed dozens of people through the course of the investigation.

TOMLIN is accused of operating a vehicle with a loaded and un-holstered firearm on his lap in a reckless manner which caused the firearm to discharge. TOMLIN shot himself in the hand and the bullet exited the vehicle in the area of East Avenue and the Batavia Middle School causing a substantial risk of serious physical injury or death to another person.

TOMLIN was released on an appearance ticket and is scheduled to appear in Batavia City Court on 7/27/2021. There is an ongoing investigation into the vehicle TOMLIN was operating that night and a vehicle of interest has been identified.

Unauthorized Use of a Motor vehicle 3rd Degree, 11:04 PM, Sunday, July 4, 2021, W. Main St. – Nicholas O’CONNOR, M/30, was arrested for unauthorized use of a motor vehicle 3rd on July 15, 2021, following an investigation into an accident that occurred on July 4th, where O’CONNOR allegedly kept a vehicle beyond the agreed upon time frame. O’CONNOR was released on an appearance ticket, and is due to appear in Batavia City Court on July 27, 2021.  

Obstruction of Governmental Administration 2nd Degree; Harassment 2nd Degree, 10:31 PM, Tuesday, July 13, 2021, Liberty St. – Melanie MARRERO, F/20, was arrested on the above listed charges following an investigation into a complaint during which MARRERO failed to comply with officer commands, physically resisted and spit on officers. MARRERO was issued an appearance ticket, returnable to Batavia City Court on 7/20/2021, and released.  

Assault 2nd Degree; Criminal Possession of a Weapon 4th Degree; Obstructing Governmental Administration, 10:23 PM, Tuesday, July 13, 2021, Liberty St. – On 7/14/2021, Shacerie RIVERA, F/24, was arrested on the above charges. It’s alleged that RIVERA cut another person in the arm with a knife. She then interfered with police, as they attempted to take another person into custody. She was arraigned in Batavia City Court and released under the supervision of Genesee Justice. RIVERA is due back in court on 8/11/2021.  

Petit Larceny, 11:35 AM, Thursday, July 8, 2021, State St. – On 7/12/2021, around approximately 12:18PM, Antonio GOODSON, M/31, was arrested after allegedly stealing two 30 packs of Budweiser beer from Save-A-Lot. GOODSON was released on an appearance ticket and is scheduled to appear in BCC on 7/20/2021 at 1:00PM with the presiding judge.  

Criminal Possession of Stolen Property in the 5th Degree, 9:37 AM, Wednesday, July 14, 2021, E. Main St. – Eric DOLEMAN, M/51, was arrested on the above charge with Amanda BOWLES (arrested for Petit Larceny) following an incident in which they allegedly shoplifted 8 pocket knives from a convenience store on E. Main St. The couple fled on foot and were located and taken into custody at a separate location. DOLEMAN and BOWLES were issued appearance tickets and are scheduled to appear in Batavia City Court for arraignment on 8/3/2021 at 1:00PM.
