GENESEE COUNTY/Indictments

Dejon J. Smith has been indicted and is accused of the crime of criminal possession of a controlled substance in the third degree, a class B felony. On February 25, 2021 in the City of Batavia, Smith allegedly knowingly and unlawfully possessed a narcotic drug, cocaine, with the intent to sell it.

In count two, Smith is accused of criminal possession of a controlled substance in the fourth degree, a class C felony. He allegedly knowingly and unlawfully possessed one or more preparations, compounds, mixtures or substances containing the narcotic cocaine, with an aggregated weight of one-eighth ounce or more.

In count three, Smith is accused of the crime of criminal possession of a controlled substance in the seventh degree, a class A misdemeanor, after allegedly knowingly and unlawfully possessing a controlled substance, alprazolam.

In count four, Smith is accused of tampering with physical evidence, a class E felony. Believing certain evidence was about to be produced or used in an official proceeding, Smith allegedly intentionally acted to prevent the evidence from being used. Smith allegedly hid a quantity of cocaine behind a stack of storage container lids in a storage shed while he was hiding from a uniformed officer who was searching for him.

In count five, he is accused of the crime of obstruction of governmental administration second degree, a class A misdemeanor. Smith allegedly intentionally obstructed, impaired or perverted the administration of law and attempted to prevent a public servant from performing an official function by means of intimidation, physical force, interference or by any independently unlawful act.

Alexander L. Baldwin has been indicted and is accused of grand larceny third degree, a class D felony. Between November 2020 and December 2020, Baldwin allegedly stole property from a couple in Genesee County, U.S. currency valued at more than $3,000.

In count two, He is accused of grand larceny 3rd after allegedly receiving funds in excess of $3,000 from the same Genesee County couple during the above date range, to perform home improvements, thus creating a trust, and then applied the funds for a purpose other than the trust purpose.

Christopher L. Taylor has been indicted and is accused of the crime of grand larceny third degree, a class D felony. Taylor allegedly stole property with a value in excess of $3,000 on or about January 16, 2021 in the Town of Pembroke.

Myles D. Macleod has been indicted and is accused of the crime of aggravated driving while intoxicated, per se, as a class E felony.

On November 27, 2020, on Route 77 in the Town of Darien, Macleod was allegedly riding a 2005 Harley Davidson motorcycle with a BAC of 18% or greater.

In count two, Macleod is accused of DWI as a class E felony while operating a motorcycle on the above date while allegedly in an intoxicated condition on the same above date and location.

In count three, Macleod is accused of aggravated unlicensed operation in the first degree for knowingly operating a motorcycle on the above date and location while his driver’s license was suspended or revoked by the State of NY and while he was allegedly under the influence of alcohol or a drug.

In count four, he is accused of circumventing an ignition interlock device, a class A misdemeanor, defendant allegedly was operating a motorcycle on the same above date and location while subject to a court ordered ignition interlock device, said motorcycle was not equipped with one.

In count five, Macleod is accused of refusing to submit to a breath test.

In count six, he is accused of operating an unregistered motorcycle, a violation, on the same above date and location.

According to District Attorney Lawrence Friedman, Macleod was previously convicted of DWI as a Class E felony on Nov. 5, 2014 in Genesee County Court. The conviction forms the basis for the suspension or revocation referred to in the current indictment and it was still in effect on the day of the crimes alleged in the current indictment.

Joel Morales Cruz has been indicted for the crime of aggravated unlicensed operation in the first degree, a class E felony. On October 25, 2020, in the City of Batavia on Oak street, Cruz allegedly drove a 1996 Honda on Oak Street while his driver’s license was suspended or revoked by the State of NY .

In count two, Cruz is accused of driving while intoxicated, as a misdemeanor on the same above date and location.

In count three, he is accused of driving while intoxicated, per se, as a misdemeanor. Cruz was allegedly operating a vehicle on the same above date and location while he had a BAC of .08% or more.

According to District Attorney Lawrence Friedman, Cruz was previously convicted of driving while intoxicated as a misdemeanor on April 22, 2010 in Batavia City Court and the conviction forms the basis for the suspension or revocation referred to in the current indictment and was still in effect.

Shane M. VanName has been indicted and is accused of the crime of criminal contempt first degree, a class E felony. On November 1, 2020, while on North Street in the Town of LeRoy, VanName allegedly violated an order of protection and is accused of intentionally harassing, annoying, threatening or alarming a protected person, or subjecting the person to physical contact or threatening to do so.

In count two, he is accused of criminal contempt second degree, a class A misdemeanor. VanName allegedly intentionally disobeyed a court order of protection out of Darien Town Court issued October 23, 2020.

In count three, VanName is accused of criminal contempt second degree after he allegedly intentionally disobeyed a court order out of Darien Town Court to stay away from a second person at the same address on North Street in LeRoy.
