WYOMING COUNTY/Attica man injures two deputies during arrest

A call to Wyoming County Sheriff’s Office for assistance with an intoxicated patron who refused to leave an establishment ended with the assault of two Wyoming County Sheriff’s Deputies on July 31, 2021.

Wyoming County Sheriff’s Deputies responded to an establishment on Route 354 in the Town of Bennington at the request of the owner for assistance in removing an intoxicated patron.

Deputies were led to Robert A. Martino, 35, of Attica, who was belligerent and uncooperative with the requests of law enforcement and establishment staff. A New York State Police Trooper responded to assist after additional units were requested.

While attempts were being made to provide Martino with a sober ride to his residence, Martino pushed a Wyoming County Deputy Sheriff. Subsequent to Martino’s actions, a ground struggle ensued as Martino actively resisted arrest. Martino was taken into custody, however during the struggle one Wyoming County Deputy Sheriff sustained a concussion, and another sustained a knee injury. Multiple pieces of equipment were also damaged during the struggle.

Martino was removed from the premises and transported to the Wyoming County Sheriff’s Office for processing.

Martino is charged with assault in the second degree, class D violent felony, criminal mischief in the third degree, a class E felony, obstruction of governmental administration in the second degree, resisting arrest, harassment in the second degree, and disorderly conduct.

Martino was arraigned in the Town of Warsaw Court where bail was set in the amount of $10,000.00 cash, $20,000.00 bond, or $30,000.00 partially secured bond.

Martino is scheduled to return to Town of Bennington Court on August 9, 2021 at 6:00p.m. for further court proceedings.
