GENESEE COUNTY/Indictments

James J. Santiago, Jr. has been indicted and accused of the crime of criminal possession of a weapon in the third degree, a class D felony, attempted assault in the third degree, a class B misdemeanor, menacing in the second degree, a class A misdemeanor, attempted criminal trespass second degree, a class B misdemeanor and trespass, a violation. On May 3, 2021, Santiago allegedly possessed a knife on Washington Avenue in Batavia, and attempted to cause physical injury to a person and allegedly displayed the knife with the intent to use it, intending to cause physical injury to another person.

Santiago Jr. is also accused of attempting to enter the dwelling of another person on the same above date, remaining there unlawfully and without permission.

Santiago Jr. was previously convicted of the crimes of criminal contempt 1st and rape 3rd degree on December 18, 2000. In October of 1996, Santiago Jr. was also convicted of attempted robbery 3rd degree. He was also convicted of attempted assault second degree in December of 2000. In April of 1996, he was convicted of the crime of petit larceny, attempted unauthorized use of a vehicle 3rd in April of 1999 in Batavia. In LeRoy, in June of 2008, he was convicted of criminal mischief 4th degree. In July of 2010, Santiago Jr. was convicted of assault 2nd degree and criminal possession of a weapon 4th degree. The above convictions form the basis for count one in the indictment, criminal possession of a weapon 3rd degree, a class D felony.

A Grand Jury has also indicted Santiago Jr. on the charges of failure to register a change of address as a sex offender, a class E felony. Santiago failed to register his address between October of 2020 and February of 2021, within 10 days after changing his address.

In Count 2, he is accused of failure to sign a verification form/confirm address, a class E felony, sometime between October of 2020 and March of 2021.

Daniel J. Wolfe has been indicted by a Genesee County Grand Jury and is accused of of burglary in the second degree, a class C violent felony, and two counts of criminal contempt in the second degree, a class A misdemeanor. Wolfe allegedly entered a dwelling with the intent of committing a crime and of violated an order of protection in the City of Batavia on November 13, 2020.

Edwin L. Stancliff has been indicted by a Genesee County Grand Jury and is accused of felony driving while intoxicated, felony driving with a BAC of .08 or greater, and criminal mischief in the third degree, a class E felony. Stancliff was allegedly driving a 2004 Chevrolet Trailblazer while allegedly intoxicated on Feb. 14, 2021 in the Town of Batavia.   He is also accused of intentionally damaging a glass door at State Police Troop A headquarters on February 15, 2021.

Stancliff was previously convicted of DWI as a misdemeanor on August 4, 2011 in Genesee County. The conviction was within 10 years of the alleged crimes in counts one and two of the current indictment.

Wayne D. Potter has been indicted by a Genesee County Grand Jury and is accused of criminal possession of a weapon in the third degree, a class D felony, menacing in the second degree, a class A misdemeanor and assault in the second degree, a class D violent felony. On Jan. 11, 2021 at 111 Liberty St. Batavia, Potter allegedly possessed a knife with the intent to use it against another person. He is accused of placing or attempting to place another person in fear of physical injury or death during the January 2021 incident. On February 16, 2021 Potter allegedly assaulted a person while confined to the Genesee County Jail at 14 West Main street.

Potter was previously convicted of false personation, a class B misdemeanor, on October 6, 2004 in Batavia City Court, assault 3rd degree, a class A misdemeanor on July 17, 2013 in City Court, and Sex offender failure to register a change of address, a class E felony and offering a false instrument for filing first degree, both on June 20, 2014 in Genesee County Court. Said convictions form the basis for count one in the current indictment.
