BATAVIA POLICE BLOTTER/Piffard woman charged after taking items from grave sites at St. Joseph’s Cemetery

Cemetery Desecration, 10:25 AM, Tuesday, August 17, 2021, Harvester Ave. – On 8/18/2021 at about 10:25 AM, it was reported that a suspicious female was observed in the St. Joseph’s Cemetery and that it appeared she was taking items from grave sites. Batavia Police responded and located Cassandra SMITH, F/35 of Main Street., of Piffard and her vehicle in the cemetery. SMITH allegedly stole numerous items including statues, planters, and flags from grave sites in the cemetery. SMITH is charged with cemetery Desecration 2nd Degree. She was released on an appearance ticket and is schedule to appear in Batavia City Court on 8/31/2021 at 1:00PM. Note: If someone has a loved one buried at St. Joseph’s Cemetery and notices items missing from their grave site, please contact St. Joseph’s Cemetery staff.  

Sex Offender – Fail to Verify Address, 9:00 AM, Sunday, December 6, 2020, W Main St. – On 8/17/2021, Batavia Police responded to the Super 8 Motel in an attempt to locate Jeremiah WILLIAMS, M/30 of Oak St., Batavia on multiple warrants. WILLIAMS was located and taken into custody on Batavia City Court Warrant #2021-00014. WILLIAMS was arraigned in Batavia City Court in front of Judge Rogers. WILLIAMS status was not reported nor was his return date.  

Harassment 2nd, 1:28 AM, Sunday, July 4, 2021, Pringle Ave. – On 8/17/2021, Batavia Police responded to the Super 8 Motel in an attempt to locate Jeremiah WILLIAMS, M/30 of Oak St., Batavia on multiple warrants. WILLIAMS was located and taken into custody on Batavia City Court Warrant #2021-00099. WILLIAMS was arraigned in Batavia City Court in front of Judge Rogers. WILLIAMS status was not reported nor was his return date.  

Bench Warrant – Failed to Appear, 1:00 PM, Tuesday, July 27, 2021, W. Main St. – Rosemary WATERS, F/35 of E. Main St., Batavia, was arrested on a Batavia City Court Warrant, following an investigation of a suspicious condition at a business on Oak Street. WATERS was arraigned in Batavia City Court at 11:00AM in front of Judge Rogers. Her status was not reported. WATERS is scheduled to return to court at a later date and time.  

Criminal Mischief 4th Degree; Endangering the welfare of a child, 4:06 PM, Tuesday, July 27, 2021, Liberty St. – On 8/16/2021, Germayne SESSION, M/27, of Gardiener Street, Rochester was arrested on the charges of Criminal Mischief and three counts Endangering the Welfare of a Child. The charges stem from a 7/27/2021 incident where SESSION, allegedly punched the windshield of a van belonging to another person causing it to shatter, while there were 3 children in the van. SESSION was issued an appearance ticket returnable to Batavia City Court on 8/23/2021, at 1:00P.M. and released.  

Bench Warrant – Failure to Appear, 12:00 PM, Thursday, July 29, 2021, W. Main St. – On 8/17/2021, Thomas TACITO, M/61, of N. Spruce St., Batavia was arrested on a warrant out of Batavia City Court. It’s alleged that TACITO failed to appear in court after he was previously arrested and issued an appearance ticket. TACITO was released on his own recognizance and is due back in court on 9/21/2021.

It’s alleged that TACITO failed to appear in court after he was previously arrested and issued an appearance ticket.

Criminal Obstruction of Breathing; Unlawful Imprisonment; Harassment 2nd, 8:18 PM, Friday, August 13, 2021, Bank St. – On 8/13/2021, Tyler GORSKI, M/19, of Bank St., Batavia, was arrested for the included charges following a physical domestic altercation. GORSKI was arraigned in front of Judge BURNS in Batavia City Court on 8/14/2021 at 11:04P.M.. GORSKI was released on his own recognizance with a return court date of 9/2/2021 at 1:30p.m..  

Criminal Obstruction of Breathing; Criminal Mischief 4th; Harassment 2nd, 10:00 PM, Friday, August 13, 2021, State St. – On 8/13/2021, Jordin SCHULTZ, M/23, or State St. Batavia, was arrested on the above charges. It’s alleged that SCHULTZ slapped another person, grabbed them by the neck and took their phone in an attempt to keep them from calling 911, during a domestic incident at a residence on State Street. SCHULTZ was arraigned by Judge ROGERS in Batavia City Court and released. He is due back in court on 9/1/2021.  

Criminal Mischief 3rd; Harassment 2nd, 2:07 PM, Saturday, August 14, 2021, Harvester Ave. – Drew FORTES-CRIMES, M/23 or Ellicott St., Batavia, was arrested at BPD Headquarters and issued an appearance ticket for the above listed charges following an investigation into a disturbance at a business on Harvester Ave. During the incident, it is alleged that FORTES-CRIMES damaged property of the victim and subjected the victim to unwanted physical contact. FORTES-CRIMES was instructed to respond to the Genesee County Jail prior to his court appearance to be processed. FORTES-CRIMES is scheduled to appear in Batavia City Court on 9/7/2021 at 09:00 A.M. FORTES-CRIMES was released.  

Harassment 2nd, 8:25 PM, Sunday, August 15, 2021, Ellicott St. – On 8/15/2021, Officer POST and Officer GOMBOS arrested Tarah MRUCZEK, F/34 of Tracy Ave., Batavia, for Harassment 2nd Degree following a domestic incident where MRUCZEK allegedly struck another person. MRUCZEK was arraigned in front of Judge ROGERS in Batavia City Court. Judge ROGERS released MRUCZEK with a return court date of 9/9/2021 at 1:30P.M.  

Criminal Contempt 2nd, 10:10 PM, Wednesday, August 18, 2021, Oak St. – On 8/18/2021, Mark FARLEY, M/53, of Oak St., Batavia, was arrested on the above charge. It’s alleged that FARLEY violated an order of protection when he was found with the protected party at a motel in Batavia. FARLEY was arraigned in Batavia City Court and remanded to the Genesee County Jail on $2,500 cash bail, $5,000 bond, and $10,000 partially secured bond. He is due back in court on 9/8/2021.
