BATAVIA/Parolee accused of raping two people after being out of prison for only 14 days

Jon T. Magliocco, 44, of Mill street, Batavia, a predicate sex offender with a level 3 designation, was released from prison on August 2nd, 2021 under the supervision of New York State Parole. By August 16, 2021, two victims came forward reporting that they had been raped by Magliocco.

The investigations are being handled by Detective Jason Ivison with the assistance of Parole Officer Jason Waldron.

The first incident occurred sometime between August 10th and 11th at an address in the City of Batavia. Magliocco is charged with rape 3rd, a class E felony, criminal sexual act 3rd, a class E felony and sexual abuse 3rd, a class B misdemeanor.

The second incident occurred sometime between August 14th and 15th at the same address in the City of Batavia. In the second incident, Magliocco is charged with criminal sexual act 1st degree with forcible compulsion, a class B violent felony. Magliocco could be sentenced up to 25 years in prison in the second incident.

In May of 2014, he was convicted of criminal sexual act 3rd, victim 21 yrs old or more/victim less than 17 yrs old, a class E felony.

On October 5, 2018, he was charged with sex offender failure to report change after allegedly failing to register an internet account on April 12, 2017. Magliocco was an inmate of DOCCS at that time.

Magliocco is a registered level 3 sex offender and is required by law to register any change in internet accounts with the NYS Division of Criminal Justice Services.

Magliocco is currently being held in Genesee County Jail.
