BATAVIA POLICE BLOTTER REPORT/September 26-October 10, 2021

Assault 2nd Degree; Criminal Possession of a Weapon, 10:28 PM, Saturday, October 2, 2021, Fisher Park. – On 10/3/2021, Officer POST arrested Rae C. COOK, F/32 of Batavia, NY, for Assault 2nd Degree and Criminal Possession of Weapon 3rd Degree after she allegedly stabbed another individual in the neck during an argument. On 10/4/2021, COOK was arraigned in front of Judge ROGERS of the Batavia City Court. ROGERS committed COOK to the Genesee County Jail in lieu of $5,000 cash, or $10,000 bond. COOK is scheduled to return to BCC on 10/7/2021 at 1:30PM.

Arson 2nd Degree; Criminal Mischief 4th Degree, 12:42 AM, Saturday, September 25, 2021, N. Spruce St. – On September 25, 2021, Mandy L. MILLER, F/41 of Batavia, NY was arrested for Arson 2nd Degree, and Criminal Mischief 4th Degree following an investigation into a domestic incident that occurred on N. Spruce St., where MILLER allegedly set fire to a carpet and a door. MILLER was arraigned in Batavia City Court by Judge BURNS and held on bail. MILLER is due to appear back in Batavia City Court on September 30th.

Public Lewdness, 8:12 AM, Monday, September 27, 2021, State St. – Myron D. DUPLER, M/74 of Batavia, NY was arrested for public lewdness on 9/27/2021 at 1:05PM. It is alleged that DUPLER had his penis out and was masturbating on the corner of State St. and Washington Ave. DUPLER was issued an appearance ticket and is due back in Batavia City Court on 10/12/2021 at 1:00 PM

Arrest Warrant, 10:25 AM, Tuesday, August 17, 2021, Harvester Ave. – Cassandra F. SMITH, F/35, of York, NY was arrested for the above listed charge and arraigned at Batavia City Court with Judge Burns presiding. SMITH failed to appear at her initial court appearance and a warrant was issued for her arrest. It is alleged that SMITH was stealing property from the cemetery located at 147 Harvester Ave. on 8/16/2021. SMITH was released on her own recognizance and is scheduled to return to Batavia City Court on 10/7/2021 at 1:30PM. SMITH was transported to the Genesee County Jail where she was processed and released.  

Bench Warrant, 9:25 PM, Friday, March 5, 2021, North St. – William A. NICHOLS Jr., M/28 of Medina, NY was located on 10/1/2021 by Medina PD. NICHOLS was subsequently turned over to Batavia Police Department on a Bench Warrant for failing to appear as directed. NICHOLS was arraigned in Batavia City Court in front of Judge Burns.  

Grand Larceny 4th; Conspiracy 5th, 7:57 PM, Saturday, July 31, 2021, Batavia, NY. – On 9/17/2021, Michael J. ROBBINS, M/61, of Batavia NY, was arrested on the above charges. It’s alleged that ROBBINS stole property at a business on E. Main St. on 7/31/21. ROBBINS was issued an appearance ticket and is scheduled to appear in Batavia City Court on 9/28/2021.

Moved from lane unsafely; Operate a motor vehicle .08% or more alcohol in blood; Driving While Intoxicated; Aggravated Driving While Intoxicated, 9:24 PM, Saturday, August 7, 2021, Bank St. – On 9/22/2021, Officer POST arrested Earnest J. REESE, M/74 of Batavia NY, for DWI following an investigation into an accident that occurred on 8/7/2021. REESE allegedly struck a parked car while intoxicated. REESE was issued appearance tickets with a return court date of 10/5/2021 at 1:00PM to the Batavia City Court.  

Harassment 2nd Degree, 6:08 PM, Monday, September 13, 2021, Union St. – On 9/18/2021, a 16-year-old juvenile was arrested on a charge of Harassment 2nd Degree. The juvenile allegedly pushed and punched another juvenile during a fight. The juvenile was issued an appearance ticket, returnable to Batavia City Court on 10/15/2021 at 1:00PM, and released.  

Driving While Intoxicated; Driving While Intoxicated with BAC >.08%, 9:55 PM, Thursday, September 16, 2021, E. Main St. – On 9/16/2021, Aaron J. MCFOLLINS, M/42, of Batavia, NY was arrested for driving while intoxicated on E. Main St. MCFOLLINS was issued appearance tickets and released, scheduled to appear in Batavia City Court on 10/05/2021 at 1:00PM.  

Driving While Intoxicated; Driving While Intoxicated with a BAC .08% or more; Aggravated DWI .18% BAC or more, 4:53 AM, Sunday, September 19, 2021, Dellinger Ave. – On 9/19/2021, Leslie R. PARRIS, M/38, of Batavia, NY was arrested after an investigation into an incident of an intoxicated operator of a motor vehicle. PARRIS was released with appearance tickets to appear in Batavia City Court.  

Speed in Zone; Driving While Intoxicated; DWI – >.08%BAC; Open Container of Alcohol in Motor Vehicle, 10:46 PM, Friday, September 24, 2021, W. Main St. – Adele J. FEELEY, F/20, of LeRoy, NY was arrested on the above date and time following a traffic stop on W. Main St. At the time of the traffic stop FEELEY was allegedly found to be operating her vehicle while intoxicated. FEELEY was processed and is to appear in Batavia City Court on October 5th, 2021 at 1:00PM.  

Criminal Possession of a Controlled Substance 7th Degree, 1:58 AM, Friday, September 24, 2021, Oak St. – On 9/24/2021, Stephanie L. COLEY, F/39 of Brockport, NY was arrested after an investigation where a City of Batavia Police Officer located COLEY sleeping in the driver’s seat of her vehicle, while parked roadside on State Route 98 in the City of Batavia. It is alleged that COLEY was in possession of a crack pipe and several small bags with an unknown white powered inside of them. COLEY was released with an appearance ticket to appear in City Court on a later date.

Criminal Mischief 3rd, 9:16 PM, Sunday, September 26, 2021, Highland Park – On 9/29/2021, Jeremy G. IVES, M/46 of Batavia, NY was arrested on the above charge. It’s alleged that IVES caused damage to a residence on Highland Park on 9/26/2021. IVES was issued an appearance ticket and is scheduled to appear in Batavia City Court on 10/12/2021.  

Driving While Intoxicated – BAC >.08% BAC; Driving While Intoxicated; Failure to use turn signal, 10:12 PM, Sunday, September 26, 2021, Main St. – On 9/26/2021, Kimberly J. POL, F/33 of Batavia, NY was arrested on the above listed charges. POL allegedly failed to use her turn signal and was subsequently determined to be intoxicated. POL was processed at the Batavia Police Department, issued uniform traffic tickets returnable to Batavia City Court on 10/12/2021 at 1:00PM and released.  

Criminal Contempt 2nd, 3:00 AM, Monday, September 27, 2021, School St. – Christopher C. TAYLOR Jr. M/21 of Batavia, NY was arrested following an investigation into a violation of an order of protection, where the defendant allegedly made threats to burn a house down. The defendant was arraigned at Batavia City Court by Judge ROGERS and released under supervision. The defendant is due to return in Batavia City Court on October 19, 2021.

Criminal Mischief 3rd, 2:11 PM, Sunday, October 3, 2021, Wood St. – Marcos VELAZQUEZ, M/18 of Batavia, NY was arrested for the listed charge, following an altercation with his sister. It is alleged that VELAZQUEZ smashed out several windows of a vehicle with a baseball bat. VELAZQUEZ was processed at the Batavia Police Department and the Genesee County Jail and issued an appearance ticket directing him to appear in Batavia City Court on 10/19/2021 at 1:00PM.  

Harassment 2nd, 9:30 PM, Monday, October 4, 2021, Eleanor Pl. – On 10/4/2021, Batavia Police arrested Jessica B. ESCHENLAUER, F/32 of Batavia, NY, for the above listed charge after responding to a residence on Eleanor Pl. for a reported physical domestic incident. ESCHENLAUER allegedly struck the victim with a wooden kitchen spoon during an argument. ESCHENLAUER was issued an appearance ticket scheduling her to appear in Batavia City Court on 10/19/2021 at 1:00PM.  

Criminal Mischief 4th, 4:19 PM, Monday, October 4, 2021, Manhattan Ave. – Jery RILEY III, M/43, of Batavia, NY was arrested on the above listed charge following an investigation into an incident where he allegedly damaged a door inside a residence during an argument. RILEY III was later arraigned in BCC, released on his own recognizance and is scheduled to appear in Batavia City Court on 10/7/2021.  

Harassment 2nd, Wednesday, October 6, 2021, Hutchins Pl. – On 10/6/2021, a 17-year-old juvenile was arrested on the above listed charge. It’s alleged that the juvenile threatened physical harm to another person, during an argument on Hutchins Pl. The juvenile was arraigned in Batavia City Court by Judge BURNS and released on his own recognizance. He is due back in court on 10/28/2021.
